1. The principle of sovereignty. The principle of sovereignty, that is, the principle that foreigners should be held accountable for crimes committed and Chinese laws should be applied, is the primary principle in foreign affairs. Article 16 of our country stipulates that if foreigners commit crimes and should be held criminally responsible, the provisions of this law shall apply.
2. Comply with the principles of international treaties. That is to say, when the public security and judicial organs handle foreign-related criminal cases, while applying our country's criminal procedure law, they should take into account the international treaties that our country has concluded or participated in, and perform corresponding obligations in accordance with the provisions of the treaties.
3. The principle of equal rights in litigation. The principle of equal litigation rights means that foreigners participating in criminal proceedings in China shall enjoy the same litigation rights as Chinese citizens in accordance with the law and bear the same litigation obligations.
4. The principle of using China’s common spoken and written language in litigation. The use of the country's common spoken and written language in litigation is a common legislative practice in various countries and an important manifestation of the independent exercise of national judicial sovereignty. Therefore, it is also the guiding principle of my country's foreign-related criminal proceedings.
5. Principles of appointing or entrusting Chinese lawyers to participate in litigation. The lawyer system is an important part of a country's judicial system and should only be applied within the country's borders and should not be extended abroad. Sovereign countries do not allow foreign judicial systems to interfere with their judicial affairs, which is also an important manifestation of the principle of sovereignty.
Article 6 Territorial Jurisdiction of Criminal Law This law shall apply to all crimes committed within the territory of the People's Republic of China, unless otherwise provided by law.
