Criminal cases are prosecuted by the procuratorate, and incidental civil lawsuits are prosecuted by the parties themselves. Generally speaking, the court where you file a lawsuit is the court where the procuratorate files a lawsuit. After the case reaches the procuratorate, as the victim, you can file a criminal lawsuit with a civil lawsuit, collect evidence, and write a criminal with a civil indictment. You can submit it to the procuratorate or the court. You can also entrust a lawyer to represent you with full authority. Generally, the court has a sample civil complaint, which is written on it. Fill in your personal information such as the defendant's personal information, phone number and home address. Reasons for prosecution and requests, etc. If you don’t know how to write it, you can ask the court and someone will tell you how to write it. Generally, judges who hear criminal cases will hear incidental civil cases at the same time and will not set up separate courts. The procedure is the same as in civil litigation.

Legal objectivity:

Article 119 of the "Civil Procedure Law of the People's Republic of China" must meet the following conditions: (1) The plaintiff has a direct interest in the case Citizens, legal persons and other organizations; (2) There is a clear defendant; (3) There are specific requests, facts and reasons; (4) It falls within the scope of civil litigation accepted by the People's Court and is under the jurisdiction of the People's Court against which the suit is filed.
