How to obtain a lawyer's practice certificate

Those who support the Constitution of People's Republic of China (PRC) and meet the following conditions may apply for a lawyer's practice certificate:

1, lawyer qualification;

2. Internship in a law firm for one year;

3. Good conduct.

There are two ways to qualify as a lawyer:

(a) to participate in the national unified examination for the qualification of lawyers. Persons who meet the following conditions may sign up for the lawyer qualification examination:

1. China citizens who support the Constitution of People's Republic of China (PRC) and enjoy the right to vote and stand for election;

2. Obtain a bachelor's degree or above in law school or non-law major or equivalent professional level;

3. Good conduct.

(two) granted by the Ministry of justice for examination and approval. People's Republic of China (PRC) citizens who support the Constitution of People's Republic of China (PRC), have good conduct, are in good health, are under 65 years old, have a bachelor's degree in law or above in institutions of higher learning, can engage in full-time lawyer work after being granted lawyer qualification, and meet one of the following conditions, can apply for examination to be granted lawyer qualification:

1, engaged in legal education or research in higher law colleges (departments) or legal research institutions, and has obtained senior titles;

2, with a master's degree in law, have more than three years of legal work experience or work in a law firm for more than one year;

3, other senior titles or equivalent professional level, can be awarded the qualification of lawyer.

People's Republic of China (PRC) Lawyers Law

Article 2 The term "lawyer" as mentioned in this Law refers to a practitioner who has obtained a lawyer's practice certificate according to law, accepted entrustment or assignment, and provided legal services to clients.

Lawyers should safeguard the legitimate rights and interests of the parties and correctly implement the law and social fairness and justice.

Article 3 Lawyers must abide by the Constitution and laws, and strictly abide by lawyers' professional ethics and practice discipline.

Lawyers' practice must be based on facts and take the law as the criterion.

Lawyers' practice should be supervised by the state, society and the parties concerned.

Lawyers' legal practice is protected by law, and no organization or individual may infringe upon the legitimate rights and interests of lawyers.

Article 4 The judicial administrative department shall supervise and guide lawyers, law firms and lawyers' associations in accordance with this Law.
