If the online filing has not been completed within three working days, it should be that the materials submitted by the parties and agents do not comply with the regulations. The judge filing the case shall complete the review and process the online case filing application within five working days from the date the system receives the prosecution materials. If the legal conditions for prosecution are met, the case should be filed and registered in a timely manner: if the materials submitted by the parties or agents do not meet the requirements, the judge should fully inform the materials that need to be supplemented and corrected and the time limit at one time. If it meets the legal requirements after making corrections within the prescribed period, it will be registered. If corrections are not made within the time limit or the corrections do not meet the requirements, it will be ruled not to be accepted: if the litigation of the parties does not meet the statutory conditions and cannot be resolved through supplements and corrections, the ruling will be made not to accept it.
Article 8 of the "Regulations of the Supreme People's Court on Several Issues Concerning the Filing and Registration of Cases in People's Courts" If the people's court cannot judge on the spot whether a lawsuit or private prosecution filed by a party complies with legal provisions, it shall handle it as follows:
(1) For civil or administrative prosecutions, a decision shall be made within seven days from the date of receipt of the complaint whether to file the case.
(2) For criminal private prosecution cases, a decision shall be made within 15 days from the day after receiving the private prosecution letter whether to file the case.
(3) The third party shall decide whether to file a case within 30 days from the date of receipt of the complaint.
(4) If there is any objection to the execution, a decision shall be made within fifteen days from the date of receipt of the complaint whether to file a case. If the people's court cannot determine whether the prosecution or private prosecution complies with legal provisions within the statutory time limit, it shall file the case first.
Generally, online filings will be reviewed within 7 days. Before this, the status is usually pending review, so don’t worry too much. Seven days is basically enough. If you are in a hurry, you can also call the filing division of the court directly and tell the judge to apply for filing online so that the judge can quickly review it.
The current system does not run particularly smoothly. The suggestions are as follows:
1. Call the filing tribunal to inquire;
2. It is recommended to mail the filing materials to the filing tribunal;
3. If you have time to file the case, It is best to go by yourself (or hire a lawyer), and you can report the matter in time.
