Regulations of Shenzhen Special Economic Zone on Comprehensive Management of Social Security

Chapter I General Provisions Article 1 In order to maintain the social order of the Shenzhen Special Economic Zone (hereinafter referred to as the Special Zone) and ensure the smooth progress of the reform, opening up and economic construction of the Special Zone, these Regulations are formulated in accordance with the Decision of the NPC Standing Committee on Strengthening the Comprehensive Management of Social Security and in light of the actual situation of the Special Zone. Article 2 Comprehensive management of social security is an important task of upholding the people's democratic dictatorship and a common task of the whole society. It is necessary to mobilize and organize the forces of the whole society and use political, legal, administrative, economic, cultural and educational means to comprehensively manage social security and social order, combat and prevent illegal crimes, and maintain social stability. Article 3 People's governments at all levels shall incorporate the comprehensive management of social security into the overall planning of building material and spiritual civilization and governing the city according to law, formulate the comprehensive management plan of social security, and implement target management.

The Shenzhen Municipal Committee for Comprehensive Management of Social Security (hereinafter referred to as the Municipal Committee for Comprehensive Management of Social Security) shall be established to be in charge of the comprehensive management of social security in Shenzhen Special Zone. Article 4 The public security organ is the competent department of social security, which implements public security management in accordance with the provisions of laws and regulations, cracks down on illegal and criminal acts that disturb social security and maintains social order. Article 5 The principle of territorial management and whoever is in charge is responsible for the comprehensive management of social security; Give priority to prevention and strike at the same time; The principle of treating both symptoms and root causes; Principles of leadership responsibility system for public security management; Principles of social security, pension and reward. Article 6 These Regulations shall apply to all units and individuals in Shenzhen Special Zone. Chapter II Organizational Structure and Responsibilities of the Comprehensive Management Committee Article 7 All districts, towns and sub-district offices shall set up committees for comprehensive management of social security, which shall be responsible for the comprehensive management of social security within their respective jurisdictions under the leadership of the Municipal Comprehensive Management Committee.

Comprehensive management committees at all levels set up offices to handle daily work. Article 8 The main duties of the Comprehensive Management Committee are:

(a) to publicize and implement the laws, regulations and relevant provisions of the comprehensive management of social security, and to implement the relevant decisions of superiors;

(two) to formulate the work plan for the comprehensive management of social security in this area, and organize the implementation;

(three) to organize and coordinate the law enforcement work of the law enforcement departments of public security management, and comprehensively manage the preventive measures and group prevention and treatment work of all units;

(four) to inspect and supervise the public security management of all departments and units, and to assess the leadership responsibility system for public security management;

(five) investigation and study, summed up the promotion experience, in recognition of advanced.

Grass-roots committees for comprehensive management of social security shall cooperate with public security organs to crack down on public security violations, build civilized and safe communities, guide and help neighborhood (village) committees to carry out joint defense of public security, and assist relevant departments to manage temporary and floating population. Chapter III Combating Illegal Crimes Article 9 Public security organs, procuratorial organs and judicial organs shall, within the scope of their statutory duties, crack down on illegal and criminal activities in public security according to law. Criminals who seriously disrupt social order, such as murder, theft, robbery, fraud, kidnapping and extortion, smuggling and selling, manufacturing and selling obscene articles, gambling, prostitution, manufacturing and selling counterfeit banknotes, theft and robbery, and possession of guns and ammunition, will be severely and quickly punished. The planners, organizers and underworld organizations that commit the above crimes should be targeted. If an enterprise as a legal person commits a crime, the criminal responsibility of the legal representative of the enterprise shall be investigated according to law.

The judicial organs shall promptly put forward suggestions to the relevant units on the problems found in the handling of social security management cases. Article 10 The management unit of the management line of the special zone shall release the personnel entering the special zone in strict accordance with the provisions of the special zone, prohibit the personnel without legal certificates from entering, and promptly deal with the illegal and criminal acts on the management line; The isolation facilities of the special zone management line shall be inspected and maintained regularly, and the damaged equipment and road facilities shall be repaired in time. Eleventh public security organs should strengthen investigation and solve cases, improve the ability to find and arrest criminals; Organize patrol officers to strengthen patrols in public places such as streets, stations, docks and residential areas, and severely crack down on existing crimes such as robbery, theft and fraud.

The public security organ shall strengthen the traffic management, fire control management and public security management of special industries in the special zone; Strengthen the public security management of temporary residents and floating personnel in rental houses, strengthen safety precautions, and often clean up those without legal documents; Timely discover and investigate cases of public security violations, and ban illegal acts according to law. Article 12 Public security, procuratorial and judicial organs shall promptly accept and deal with citizens' complaints, exposures and accused criminals, and protect the safety of accused, exposed and accused criminals. The public security organ shall arrive at the scene in time to stop and deal with the current illegal and criminal cases reported by citizens according to law. Chapter IV Public Security Prevention and Group Prevention and Group Governance Article 13 The judicial administrative department shall strengthen people's mediation, channel civil disputes and prevent conflicts from intensifying; Conscientiously implement the policy of reeducation through labor, improve the quality of reform, assist streets, towns, relevant departments and units to do a good job in the education of released prisoners and their return to society, and reduce the recidivism rate; Do a good job in publicity, notarization, lawyers and other legal services. Fourteenth civil affairs departments should strengthen the construction of grass-roots political power and mass autonomous organizations; Do a good job in the detention and repatriation of relevant personnel, manage drug rehabilitation centers according to law, and do a good job in drug rehabilitation for drug addicts; It is necessary to gradually improve the conditions of reception stations and improve the effect of reception education. Fifteenth labor administrative departments should strengthen the supervision and inspection of enterprise recruitment. Do a good job in mediation and handling of labor disputes to prevent and stop the intensification of contradictions; Do a good job in vocational training and employment of unemployed people, provide services for the re-employment of laid-off workers in enterprises, and provide employment assistance for those released from prison and released from reeducation through labor.
