The case of intentional injury of Lijiang college students has aroused widespread concern in society. 65438 10/7, the People's Court of Gucheng District, Lijiang City, Yunnan Province held a public hearing and pronounced the case that the People's Procuratorate of Gucheng District accused the defendant Cheng Zhaodong of intentionally injuring the incidental civil action, sentenced the defendant Cheng Zhaodong to three years' imprisonment, suspended for four years, and ordered him to compensate the plaintiff in the incidental civil action for economic losses of 277,480.68 yuan.
Previously, after the case was tried by the People's Court of Gucheng District, a criminal incidental civil judgment was made on 20 19 10 15. Defendant Cheng Zhaodong and plaintiffs Wang Mokuan and Dai refused to accept the judgment and appealed. Lijiang Intermediate People's Court decided to send the case back to the People's Court of Gucheng District for retrial on May 6, 2020.
The court found that there was a contradiction between Zhao Dong and Wang Mokuan and Dai Mou due to trivial matters. On the evening of 20 18165438+10/8, more than 20 people, including Cheng Modong, Wang Mokuan, Dai Mou, Zeng Mokai, Li Mobo and Li Mouquan, were invited to attend a birthday party held by Lei Moumou in a hotel in Old Town of Lijiang. During the party, Cheng Zhaodong and Wang Mokuan had an altercation because of drinking. After Cheng Zhaodong invited Wang Mokuan to talk in the restaurant, Wang Mokuan returned to the restaurant and Cheng Zhaodong left the restaurant. About half an hour later, Cheng Zhaodong returned to the restaurant and was immediately persuaded out of the restaurant regardless of others' dissuasion. Then Wang Mokuan and Dai also walked out of the restaurant, and the others also walked out of the restaurant one after another. Cheng Zhaodong had a dispute with Wang Mokuan, Dai and others at the entrance of the restaurant. After pulling and pushing each other, they started fighting. In the process, Zhong Zhaodong stabbed Wang Mokuan, Dai Mou, Zeng Mokai, Li Mobo and Li Mou with a knife. It was identified that Wang Mokuan and Dai were seriously injured, Zeng Mokai was slightly injured, Li Mobo was slightly injured and Li Mouquan was slightly injured. After the five victims were injured, they went to the hospital for treatment, and Cheng Zhaodong's family paid the medical expenses * * * 15 1 187 yuan.
The court held that the defendant Cheng Zhaodong intentionally injured the health of others with a knife, causing two serious injuries, two minor injuries and one minor injury. His behavior has violated the criminal law and constituted the crime of intentional injury. The facts of this case are clear, the evidence is true and sufficient, and the charges charged by the public prosecution agency are established. The victim in this case was at fault, and Cheng Zhaodong and his family actively compensated the victim for some economic losses, so they can be given a lighter punishment. If the defendant Cheng Zhaodong's criminal behavior causes economic losses to the plaintiff in the incidental civil action, the defendant Cheng Zhaodong shall bear the corresponding liability for compensation according to the degree of his fault. The court comprehensively considered the facts, nature and circumstances of Cheng Zhaodong's crime and the degree of harm to society, and made the above judgment according to law.
Defendant Cheng Zhaodong, his defender, agent ad litem, plaintiff in incidental civil action and agent ad litem attended the proceedings in court. The defendant's family, deputies to the National People's Congress, members of the CPPCC, the news media and some people attended the trial and pronounced the sentence.
