In the trial of the case of *, many defendants, such as *, said in court that they were tortured to extract confessions, among which * was the most severe and cruel. * Self-reported that he was beaten to death, his teeth were knocked out, his tongue was punctured, he was hanged and electrocuted all over his body, * he was electrocuted, * his clothes were thrown cold water in winter and frozen outdoors for a long time, and so on (attached with the detailed materials of self-reported torture). His statement in court, the scars he showed in court, two bloody clothes he showed in court and two witnesses who testified in court fully confirmed the fact that the confession was obtained through torture. * This case is a case with great influence in Jilin Province and Jilin City, and its task force is directly led by Li Haibin, secretary of the Political and Legal Committee of Jilin City and director of the Public Security Bureau. In the process of handling this case, Jilin Public Security Bureau arrested people in the name of being involved in black and evil, arbitrarily sealed up and frozen huge enterprise assets that were legally operated, severely extorted confessions by torture, and arbitrarily created misjudged cases (the case involving black and evil was filed, but the procuratorate gave up the accusation of being involved in black and evil, indicating that black and evil did not exist). We all agree that Li Haibin bears direct responsibility for this.
The Jilin Provincial Political and Legal Committee issued the "Eight Prohibitions for Police Officers in Jilin Province" in XX, stipulating that "it is strictly forbidden for police officers not to answer, extort confessions by torture, beat and scold criminals and criminal suspects"; The Political and Legal Committee of the Provincial Party Committee stressed that "police officers who violate the' eight prohibitions' should be investigated for disciplinary responsibility or criminal responsibility according to discipline and law. Those who engage in law enforcement posts shall be transferred from law enforcement posts and shall not engage in law enforcement posts within 3 years. If the violation of the above ban is concealed, not investigated, or sheltered, causing the department to violate the ban continuously or repeatedly, causing adverse effects, the direct leaders and main leaders of the unit should take the blame and resign. "
Therefore, we believe that in Jilin City Public Security Bureau, wrongly prosecuting and extorting a confession by torture on charges related to gangsters directly violated the relevant laws and regulations, which constituted the crime of extorting a confession by torture, and of course violated the "eight prohibitions" promulgated by the Political and Legal Committee of Jilin Province, which seriously damaged the image of police officers in Jilin Province and had a negative impact on the political and legal work in Jilin Province.
