Legal basis: "Provisions of the Supreme People's Court on Several Issues Concerning the Registration and Filing of Cases by People's Courts"
Article 3 A people's court shall provide a sample of the complaint to provide a model and guidance for the parties to write the complaint. If a party has difficulty in writing a complaint, it may file it orally and the people's court shall record it. According to the law, it should be registered.
Article 4 A civil complaint shall record the following items: (1) The name, sex, age, nationality, occupation, work unit, domicile and contact information of the plaintiff, the name and domicile of the legal person or other organization, and the name, position and contact information of the legal representative or principal responsible person; (2) information such as the defendant's name, gender, work unit and domicile, and information such as the name and domicile of a legal person or other organization; (3) the claim and the facts and reasons on which it is based; (4) evidence and sources of evidence; (5) If there is a witness, the name and domicile of the witness. The administrative indictment is written with reference to the civil indictment.
Article 5 The following items shall be stated in the criminal indictment: (1) The name, sex, age, nationality, education level, occupation, work unit, address and contact information of the private prosecutor or informant and defendant; (2) The time, place, means, circumstances and harmful consequences of the crime committed by the defendant. 3) Specific claims; (4) the method and time of bringing a suit in a people's court; (5) the name and source of the evidence; (six) the name, domicile and contact information of the witness.
Article 6 Where a party files a lawsuit or private prosecution, the following materials shall be submitted: (1) If the person who files the lawsuit or private prosecution is a natural person, a copy of the identity certificate shall be submitted; If the prosecutor or private prosecutor is a legal person or other organization, a copy of the business license or organization code certificate and a copy of the identity certificate of the legal representative or principal responsible person shall be submitted; If a legal person or other organization cannot provide the organization code, it shall provide the certificate that the organization has been cancelled. If the organization code cannot be provided, a statement of cancellation of the organization shall be provided; (2) If a person is entrusted to sue or tell on his behalf, he shall submit the power of attorney, the identity certificate of the agent, the identity certificate of the person telling on his behalf and other relevant materials; (3) Specifying the name and domicile of the defendant or the defendant that can distinguish him from others; (four) the original indictment and the number of defendants and the relationship between the defendants and other parties to the case (five) evidence or proof materials related to the indictment.
article 7 if the complaint and materials submitted by the parties do not meet the requirements, the people's court shall inform the parties in writing to make corrections within a time limit. If the parties make corrections within the specified time limit, the time limit for the people's court to decide whether to file a case shall be counted from the date of receiving the corrected materials. If the parties fail to make corrections within the specified time limit, the complaint shall be returned to the court and recorded; If the parties insist on prosecution or private prosecution, the court shall rule or decide not to accept or file a case. If it still does not meet the requirements after correction, the ruling or decision shall not be accepted or filed.
