1. When the public security bureau or the police station arrest a person, the arrested person can immediately ask a lawyer, but he cannot be accompanied by a lawyer. Paragraph 1 of Article 33 of the Criminal Procedure Law stipulates: "A criminal suspect has the right to entrust a defender from the day when he is interrogated for the first time by the investigation organ or takes compulsory measures; Only lawyers can be entrusted as defenders during the investigation. " When a public security bureau or police station arrests a person, it means taking compulsory measures against him, and the arrested person has the right to ask an attorney to defend him. However, the criminal procedure law does not stipulate that a lawyer can accompany him, so the arrested person cannot ask a lawyer to accompany him.
2. The arrested person cannot keep silent, and there is no provision for the right to silence in China. Article 1 18 of the Criminal Procedure Law stipulates: "A criminal suspect shall truthfully answer questions raised by investigators. However, I have the right to refuse to answer questions irrelevant to this case. " People arrested by public security bureaus and police stations belong to criminal suspects. According to the law, the arrested person should truthfully answer the questions of public security personnel, that is, investigators, and cannot remain silent. Only for questions irrelevant to the case, the arrested person has the right to remain silent and refuse to answer.
