According to the criminal law, it is a crime to illegally grow more than one poppy.

It is illegal to grow poppies, and there is no limit to the quantity. As long as there is illegal cultivation, it is illegal and should bear corresponding legal responsibilities.

According to the law, planting more than 500 poppies is a criminal case, and less than 500 poppies are generally treated as public security cases. Whoever illegally grows more than 3,000 opium poppies or other narcotic plants shall be sentenced to fixed-term imprisonment of not less than five years and shall also be fined or confiscated.

1. Article 35 1 of China's Criminal Law clearly stipulates:

1, illegal cultivation of opium poppy, marijuana and other drug plants will be forcibly eradicated by the white system. Under any of the following circumstances, he shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance, and shall also be fined.

(1) Planting more than 500 opium poppies and less than 3,000 opium poppies, or planting a relatively large number of other narcotic plants.

(2) planted after being handled by the public security organ.

(3) Resist eradication.

2. Whoever illegally cultivates more than 3,000 original plants of opium poppy or other drugs shall be sentenced to fixed-term imprisonment of not less than five years, and shall also be fined or confiscated.

3, illegal cultivation of opium poppy or other original plants of drugs, automatically eradicated before harvest, can be exempted from punishment.

Second, the article 7 1 of China's Public Security Administration Punishment Law also has provisions;

Anyone who commits one of the following acts shall be detained for more than ten days and less than fifteen days, and may be fined not more than three thousand yuan; If the circumstances are relatively minor, they shall be detained for not more than five days or fined not more than five hundred yuan:

(1) Illegally planting less than 500 opium poppies or a small amount of other drugs;

(2) illegally buying, selling, transporting, carrying or holding a small amount of seeds or seedlings of original plants of drugs such as opium poppy that have not been inactivated;

(3) illegally transporting, trading, storing or using a small amount of poppy shells.
