Measures of Shanxi Province for closing hillsides and forbidding grazing

Article 1 In order to protect and improve the ecological environment, consolidate the results of afforestation, and realize the coordinated development of economy, society and ecological environment, these measures are formulated in accordance with the Forest Law of People's Republic of China (PRC), the Grassland Law of People's Republic of China (PRC) and other relevant laws and regulations, and in combination with the actual situation of this province. Article 2 These Measures shall apply to closing hillsides for grazing prohibition within the administrative area of this province.

The term "closing hillsides for grazing prohibition" as mentioned in these Measures refers to the management and protection measures taken by the people's governments at or above the county level to enclose the designated forest land, grassland and other areas and prohibit the release of artificially raised cattle, sheep and other herbivores. Article 3 Closing hillsides for grazing prohibition shall adhere to the principles of overall planning, giving priority to grazing, combining grazing prohibition with captivity, restoring ecology and protecting farmers' interests. Article 4 The people's governments at or above the county level shall be responsible for closing hillsides and forbidding grazing within their respective administrative areas, and shall incorporate closing hillsides and forbidding grazing into the national economic and social development plan.

The forestry administrative department of the people's government at or above the county level shall be responsible for the supervision and management of closing hillsides for grazing prohibition.

The administrative department of animal husbandry of the people's government at or above the county level shall be responsible for the supervision and management of house feeding and grassland.

The departments of development and reform, finance, agriculture, water conservancy, land and resources of the people's governments at or above the county level shall, according to their respective functions and duties, be responsible for closing hillsides and forbidding grazing.

The township (town) people's government shall specifically organize the implementation of livestock grazing prohibition in this area and implement the work of house feeding and captivity. Fifth provincial forestry administrative departments are responsible for closing hillsides and forbidding grazing in provincial state-owned forest areas.

State-owned enterprises and institutions are responsible for closing hillsides and forbidding grazing in their management and protection forest areas. Article 6 Closing hillsides to prohibit grazing shall be implemented by stages according to different regions.

(1) National key forestry engineering areas, such as natural forest protection, returning farmland to forests, sandstorm source control in Beijing and Tianjin, shelterbelts in the Three North areas and Taihang Mountain greening, afforestation engineering areas, scenic spots and nature reserves, such as corridor greening, barren hills greening along traffic lines, villages and towns greening, factories and mines greening, etc. , since the date of implementation of these measures, the implementation of closing hillsides to prohibit grazing;

(2) Yangquan City, Yuncheng City, Linfen City, Jincheng City and Changzhi City have closed their mountains to grazing since June 1 2008;

(3) Taiyuan City, Jinzhong City and Lvliang City have closed hillsides for grazing since June 5438+February 1;

(4) Datong City, Xinzhou City and Shuozhou City have closed their mountains to grazing since June 1 2009.

Encourage mature areas to shorten the transition period of closing hillsides and forbidding grazing. If it is necessary to extend the transition period of closing hillsides for grazing due to special circumstances, it shall be approved by the provincial people's government. Article 7 People's governments at the county level shall organize forestry, animal husbandry and other relevant departments to scientifically demarcate areas for closing hillsides for grazing prohibition according to the actual situation in the region, and announce the specific areas, scope and time limit for closing hillsides for grazing prohibition. Article 8 The forestry administrative department of the people's government at or above the county level shall organize the relevant units to set up obvious signs, signs, boundary markers and other facilities at the main intersections and mountain passes of the grazing prohibition area, indicating the grazing prohibition area and relevant requirements. Article 9 The people's governments at or above the county level shall commend the breeders who have made remarkable achievements in stopping free-range and captive breeding, and give subsidies to the construction of livestock and poultry houses and facilities.

Subsidy funds should be earmarked, paid in full and on time, and no interception or misappropriation is allowed.

Measures for subsidy funds shall be formulated by the financial administrative department of the provincial people's government in conjunction with relevant departments such as agriculture. Tenth people's governments at or above the county level shall be responsible for the following work:

(a) the introduction and improvement of livestock breeds, improve the proportion of livestock in captivity;

(2) introduce excellent grass seeds, improve degraded grassland, expand pasture planting area and increase pasture yield;

(three) to promote agricultural and forestry by-products such as crop straw, feed leaves and forage grass, and broaden the sources of forage grass feed;

(four) to strengthen the processing and storage of forage and the construction of livestock and poultry breeding facilities. Eleventh departments of land and resources of the people's governments at or above the county level shall, when formulating the overall land use planning, make reasonable arrangements for the land used for livestock pens. Twelfth prohibited from engaging in the following activities in grazing areas:

(a) Grazing animals, such as cattle and sheep;

(two) burning, picnic, reclamation, illegal logging;

(3) Illegal hunting and collecting of wild animals and plants;

(four) illegal mining, quarrying, sand mining and soil borrowing;

(five) moving or damaging the signs, signs and boundary markers for closing hillsides for grazing;

(six) other acts and activities that destroy closing hillsides for grazing.

The forestry administrative department of the people's government at or above the county level shall publish the contact information such as telephone, network and communication, and accept reports from the masses. Article 13 Anyone who, in violation of the provisions of Article 12 of these measures, grazes in the no-grazing area, moves or damages signs, signs and boundary markers, shall be ordered by the administrative department of forestry or the administrative department of animal husbandry to stop grazing in accordance with the statutory duties, and may also be fined more than 50 yuan 100 yuan.

If forests and trees are damaged, replant trees with more than one time and less than three times the number of damaged trees; Refusing to replant, the administrative department of forestry shall impose a fine of more than one time and less than three times the value of forest trees. Fourteenth in violation of the provisions of article ninth of these measures, the administrative organs and their staff intercept or misappropriate the subsidy funds for livestock and poultry feeding, and the relevant departments shall give administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law. Fifteenth in closing hillsides for grazing, administrative organs and their staff dereliction of duty, abuse of power, corruption, shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.
