Article 73 of the Constitution stipulates the legal status of deputies to the National People's Congress. During meetings of the National People's Congress and the Standing Committee of the National People's Congress, members of the NPC Standing Committee have the right to submit inquiries to ministries and committees of the State Council or the State Council in accordance with the procedures prescribed by law. The agency being questioned must be responsible for answering.
Ordinary lawyers, different from ancient litigation lawyers and lawyers, refer to practitioners who have passed the national judicial examination, obtained a lawyer's practicing certificate in accordance with the law, accept entrustment or designation, and provide legal services to parties.
Deputies to the National People's Congress are not subject to arrest or criminal trial when the National People's Congress is not in session, without permission from the Presidium of the National People's Congress and the NPC Standing Committee. The speeches and votes made by deputies to the National People's Congress at various meetings of the National People's Congress are not subject to legal investigation. Deputies to the National People's Congress must exemplaryly abide by the Constitution and laws, keep state secrets, and assist in the implementation of the Constitution and laws in their production, work, and social activities. Deputies to the National People's Congress should maintain close contact with the original electoral units and the people, listen to and reflect the people's opinions and demands, and strive to serve the people. Deputies to the National People's Congress are subject to the supervision of the original electoral unit. The original electoral unit has the right to remove its own elected representatives in accordance with the procedures prescribed by law. The organization and working procedures of the National People's Congress and the NPC Standing Committee are stipulated by law.
Delegates to the National Lawyers Congress are elected from individual members by the Lawyers Congress of the provinces, autonomous regions, and municipalities directly under the Central Government, or from individual members by the Board of Directors of the Lawyers Association of the Province, Autonomous Region, and Municipality directly under the Central Government. The president or vice-president of the bar associations of each province, autonomous region, and municipality directly under the Central Government is a practicing lawyer and an ex-officio representative of the National Lawyers Congress.
Delegates to the local lawyers’ congress are elected from individual members, and the election methods are stipulated by the standing council of the local lawyers association.
As needed, the Lawyers Association may invite relevant personnel to attend the Lawyers Congress as special representatives. The powers of the specially invited representatives shall be determined by the Standing Council of the Lawyers Association.
