According to Article 28 of the "People's Court Sentencing Guidance Opinions": Both statutory sentencing circumstances and discretionary sentencing circumstances should be reflected in sentencing. If the sentencing elements of lenient or severe sentencing are the same, they can be added together. If the sentencing elements coexist, they may be reduced. Article 29 stipulates: The judgment of the influence of sentencing elements shall follow the following rules: (1) Legal sentencing elements are superior to discretionary sentencing elements; (2) Occasional sentencing elements are superior to probable sentencing elements.
