First, the process of disability identification.
Disability appraisal can be divided into industrial injury disability appraisal and car accident disability appraisal.
Personal disability appraisal procedure
If a worker is injured at work and needs disability identification, he must first apply to the Human Resources or Social Security Bureau for work-related injury identification and apply within 30 days from the date of the work-related injury accident.
If the employee applies within 1 year, he/she needs to fill in the application form for work-related injury identification, and prepare the labor contract between the employee and the employer and the diagnosis certificate of the employee's medical treatment.
Employees with special circumstances may apply to the administrative department of social insurance for an appropriate extension. If a worker is unable to go to the human resources or social security bureau for work-related injury identification due to physical reasons, he may entrust his immediate family members and trade unions to help him apply for work-related injury identification.
Car accident disability appraisal procedure
According to the procedure of the Ministry of Public Security, if a party is disabled due to a traffic accident, the party concerned can go to an institution with disability appraisal qualification for disability grade appraisal after staying overnight. The public security traffic management department handling the case may also recommend a disability appraisal institution that meets the requirements of the parties. The final appraisal is chosen by the parties themselves.

Judicial interpretation of personal injury compensation
Article 17
If the victim suffers personal injury, the compensation obligor shall compensate all expenses such as medical expenses and income reduced due to missed work, including medical expenses, missed work expenses, nursing expenses, transportation expenses, accommodation expenses, hospital food subsidies and necessary nutrition expenses.
If the victim is disabled due to injury, the compensation obligor shall also compensate the necessary expenses incurred due to the increase of daily needs and the income loss caused by the loss of working ability, including disability compensation, disability AIDS, living expenses of the dependents, and necessary rehabilitation expenses, nursing expenses and follow-up treatment expenses actually incurred due to rehabilitation nursing and continuing treatment.
If the victim dies, the compensation obligor shall, in addition to compensating the relevant expenses stipulated in the first paragraph of this article according to the rescue and treatment, also compensate the funeral expenses, living expenses of the dependents, death compensation and other reasonable expenses such as transportation, accommodation, lost time and so on for the funeral expenses of the relatives of the victim.
