The difference between innocent defense and guilty defense

Legal analysis: the defense of innocence refers to the defendant and his defense lawyer defending the defendant in the trial, and there are only two results: one is that the prosecutor is supported by the court, the defendant is convicted, the defense viewpoint is adopted by the court, and the defendant is acquitted. The principle of innocent defense refers to the principle that lawyers must abide by in the process of defending defendants.

Legal basis: Article 16 of the Criminal Procedure Law of People's Republic of China (PRC) shall not be investigated for criminal responsibility under any of the following circumstances. If the investigation has been concluded, the case shall be dismissed, or no prosecution shall be instituted, or the trial shall be terminated or acquitted:

(a) if the circumstances are obviously minor and the harm is not great, it is not considered a crime; (two) beyond the limitation period of prosecution; (3) If the Amnesty is exempted from punishment; (4) failing to tell or withdraw a crime that was dealt with after being told in accordance with the provisions of the Criminal Law; (5) The criminal suspect or defendant dies; (six) other laws and regulations exempt from criminal responsibility.
