I. Purchase of legal services
It is planned to hire 1 law firm and assign more than 2 lawyers to provide legal counsel and resident lawyer services for our bureau for a period of 1 year. Services mainly include:
(1) Legal consulting service
1. Provide legal advice for major decisions and major administrative actions of this unit;
2 to participate in the drafting and demonstration of the draft regulations, the draft internal party regulations and the draft normative documents drafted by the unit;
3. Participate in the negotiation of cooperation projects and assist in drafting and amending important legal documents or major contracts;
4. To provide legal services for handling legal litigation cases, letters and visits cases and major emergencies;
5. Participate in handling administrative reconsideration, litigation, arbitration and other legal affairs;
6. Provide 1-2 legal training services every year.
(2) Resident lawyer service
1. Go to the resident law firm at least once a week to provide comprehensive consulting services for the daily law enforcement work of the urban management law enforcement team;
2. Assist in legal publicity and training;
3. At the request of the urban management department, issue a lawyer's letter and legal opinion to the administrative counterpart; To assist in the enforcement of administrative penalty applications, administrative reconsideration, administrative litigation and related civil litigation cases, and participate in relevant hearings;
4 to participate in major, complex and difficult law enforcement activities;
5. Participate in the collective discussion of major cases of this unit as required;
6. Supervise urban management law enforcement officers to perform their duties according to law, standardize law enforcement procedures, and promptly correct the non-compliance of law enforcement officers in the process of law enforcement;
7. To provide legal services for handling law-related litigation cases and major emergencies, and act as an agent for lawsuits that hinder urban management law enforcement and violent anti-law behaviors.
The specific service matters shall be subject to the contract.
Second, to undertake the qualification requirements of the main body
(1) Qualification requirements of law firms
1. must be a law firm approved by the judicial administrative organ according to law;
2. At least one partner shall have the experience of being a legal adviser to the government and its departments or working in an administrative organ or a judicial organ;
3. No bad practice record in the last three years.
(2) Qualification requirements for legal advisers and resident lawyers.
1. Engaged in lawyer work for more than five years, familiar with administrative laws and regulations;
2 employed lawyers must have a bachelor's degree or above, be familiar with administrative laws and regulations, and have the ability to handle daily legal affairs of urban management law enforcement departments;
3. The assigned lawyer should have high political quality, strong professional ability, good professional ethics and social responsibility, be diligent and dedicated, work efficiently, have no criminal record, have not received disciplinary punishment, administrative punishment by the judicial administrative department or industrial punishment by the bar association, and are not suspected of violating the law and discipline and are being investigated and examined by relevant organizations or organs.
Third, the selection process.
1. Register for the election. 2. Review and compare. Our bureau will examine the qualifications of registered law firms in accordance with the principles of openness, fairness and impartiality, and comprehensively consider the service plan, quotation, professional background, practical work experience and other factors of the law firm to determine the preliminary list of selected law firms.
3. sign the contract. After determining the final law firm, sign a service contract.
