Legal analysis
Circumstances in which you can apply for an adjournment of the hearing: (1) The parties who have to appear in court and other participants in the proceedings do not appear in court with justifiable reasons; (2) The party concerned temporarily applies for withdrawal; (3) It is necessary to notify new witnesses to appear in court, obtain new evidence, re-authenticate, conduct an inquest or make supplementary investigations; (4) Other circumstances that should be postponed. If a party is seriously ill, he may apply for an extension of the hearing on the grounds of (1). If the personal reasons of the parties are reasonable and lawful, point (4) may be included as the reason for postponing the hearing. What needs to be done is to write an application for postponing the trial and submit it to the judge of the civil court in charge of hearing the case, who will decide whether to postpone the trial. The longest extension period in an extension application can only be six months. In the application for extension, the reasons for extension must be legal circumstances that can postpone the trial, otherwise the court will generally not approve it after accepting it. Whether it is a civil dispute case or a criminal case, the court needs to conclude it within a time limit. If it is necessary to extend the trial period under special circumstances, the trial must be extended in accordance with the procedural requirements. If no request is made and the trial is not completed within a limited time, the relevant judicial staff will be punished.
