How to organize files

Documents. People who work in public security law pay more attention to files than lawyers. Because these files should be filed, preserved and consulted in strict accordance with the provisions of the Archives Law, and at the same time, these files should be tested by history, it is a very serious illegal act, even a criminal act, for the staff of the public security inspection law to lose damaged archival materials and tamper with forged archival materials. Therefore, we can understand why the judges of the court can not express their opinions when they receive our defense, proxy statement, evidence list and other documents, no matter how fierce the wording in the documents is or even directly accuse them of perverting the law, but also file these documents and save them on schedule. A complete case file can reflect the work done by the case handler in the whole case, clearly reflect his judgment and analysis of the case, and completely reproduce the main facts of the case, which is the first-hand material for studying and evaluating the case. People engaged in the legal service industry should pay attention to the filing, sorting and preservation of files. I suggest that novice lawyers and paralegals pay attention to files, organize files, save files and study teachers' files. This will help you develop and establish good practice habits. I have visited some small firms. Many firms do not have a unified printing folder for cost reasons, so there is no filing and preservation system for documents. Lawyers who practice in small firms generally don't keep files, but keep at most one judgment, sometimes even a judgment, after closing the case. When the case was finished, the case file was lost. When the client needs the materials of a case, it is inconvenient for the lawyer in charge to go to the court archives to retrieve and copy the files. I have compiled files for teachers in the office, and I am still using the methods taught by teachers. Therefore, I have filed all my cases, and the evidence materials, documents and legal basis of each case are complete. I want to share this experience with young lawyers. A case file records a case you handled, proves your achievements and carries your experience. No matter what the practical significance is, at least in your career, it has certain historical significance. A complete case file needs the following materials: 1) case file cover. If your practice office doesn't print the cover, I suggest you buy a ready-made folder and use the cover as the document in the volume. 2) File directory. A document, ranging from dozens of pages to hundreds of thousands of pages, should be classified and compiled into a directory for easy reference. 3) Power of attorney and agency contract. These documents can be photocopies, but they are necessary materials for the case file. 4) Judgments, rulings, judgments, notices of responding to lawsuits, notices of giving evidence, notices of appearing in court, court summons, etc. Relevant court documents are placed at the top of the document. 5) Lawyers' documents such as indictments, pleadings, proxy words, applications, legal opinions, memos, and opinions on giving evidence and cross-examination. 6) The plaintiff's evidence list and evidence documents. 7) The defendant's evidence list and evidence documents. In order to save trouble, some lawyers only provide one set of evidence when giving evidence, which causes the opposing agent to copy the documents himself. At present, the court requires the author of the evidence to copy the evidence according to the number of the other parties and provide it to the court. In this way, you have all the evidence provided by the parties in this case, which needs to be filed. 7) Closing report. The closing report is attached to the end of the case file to prove the integrity of the case. You'd better find a safe place to store your documents and then fold them one by one. In fact, you will be very happy when you look at them, which is also an invisible encouragement to you. Successful literati works are equal, and so are mature lawyer files. When you have a file about 100, no one will say that you are still a novice, and you will be full of confidence in your future. Please believe me. In a word, the above list is only the order and content of the documents when I filed them. I think these contents are necessary when filing. You may have a better and more comprehensive filing order and content. At present, many firms use a file box and a plastic box, which can store hundreds of pages of materials, but one disadvantage is that one or two pages are easily lost. I suggest that it is best not to put the case materials in a box, which is messy and messy, and the order will be confused every time you look up it. Some firms don't allow lawyers to keep their own files. After the case is closed, the file should be handed in.
