However, compared with the first trial, the second trial adopted the opinions of Cheng Yuan's family in one place-the court found that the property and income of 17 enterprise in the original judgment were improperly recovered and confiscated and should be revoked.
The Higher People's Court of Liaoning Province ruled that the existing evidence could not prove that Yuan Chengjia's 17 enterprise and its account funds were used for illegal and criminal activities, which was related to organized crimes of a triad nature. The funds, vehicles and frozen funds in these enterprises have been recovered and confiscated improperly, and the organs that have been sealed up, detained and frozen have made a return judgment according to law.
The revision of this key point has laid an important foundation for Cheng Yuan's family to strive for state compensation.
After a year and a half of preparation, Yuan Chengjia, who was still serving his sentence, entrusted a lawyer to submit an application for state compensation of more than 3.73 billion yuan to the Liaoning Provincial Public Security Bureau in accordance with the relevant provisions of the State Compensation Law. On May 15, the Liaoning Provincial Public Security Department issued a certificate, indicating that it had received the application materials for state compensation in Yuan Chengjia's case, including 12 pages of compensation application, 75 pages of evidence materials and 874 pages of the first and second instance judgments. This voucher is stamped with "Special Seal for State Compensation of Liaoning Provincial Public Security Department".
After nearly three months, the Liaoning Provincial Public Security Department checked the above compensation request and finally made a compensation decision. Although public opinion is shocked by this, it is not unexpected.
