Public security cases refer to violations of public security management laws and regulations that should be punished by public security management in accordance with the law, and are investigated and punished by public security organs in accordance with the law. Security cases correspond to criminal cases. The two cannot be confused.
Cases transferred by administrative agencies to judicial agencies such as reports, accusations, reports, mass surrenders or surrenders, etc., shall be accepted and registered in a timely manner, and the following handling shall be carried out respectively:
1. If the incident is under the jurisdiction of the unit where the incident occurred, it shall be investigated and dealt with in a timely manner;
2. If it is under the jurisdiction of other public security organs and units, the case shall be accepted within 24 hours after the transfer, and the case shall be investigated and dealt with within 24 hours after the transfer.
2. If it falls under the jurisdiction of other public security organs, it shall be transferred within 24 hours after acceptance, and the parties shall be informed;
3. If it does not fall within the scope of the public security organ’s responsibilities, it shall be informed The parties concerned shall report the case to other relevant competent authorities or surrender.
Public security cases refer to cases in which public security organs and grassroots security and protection organizations confirm and investigate in accordance with the law violations of relevant regulations and minor violations that are not sufficient for criminal punishment and require administrative penalties. Public security cases that occur in society are generally handled by the local police station; security cases that occur within agencies, groups, enterprises, and institutions are handled by the security organization of the unit. If there is no security organization, the local public security agency is responsible for the investigation. In addition, in rural areas where there are no public security police stations, the public security organs can entrust the township (town) people's government to issue warnings or fines of less than 50 yuan for violations of public security management.
Article 286 of the "Criminal Procedure Law of the People's Republic of China" If a person is under the age of 18 at the time of committing a crime and is sentenced to a penalty of not more than five years in prison, the relevant criminal records shall be sealed. Sealed criminal records may not be inspected by any unit or individual except for the needs of judicial organs for handling cases or for inquiries by relevant units in accordance with national regulations. Units that conduct inquiries in accordance with the law shall keep sealed criminal records confidential.
