Do you want your family to pay for the death penalty?

According to Chinese laws, the family members sentenced to death do not need compensation, and the relatives of the defendant have no obligation to compensate the victims. According to the regulations, the victim's family can file a lawsuit for criminal incidental civil compensation. The court will award the defendant personal property compensation, and the defendant's relatives have no obligation to compensate the victim. If they lose the case, the court will consider a lighter sentence.

Being sentenced to death is only a criminal responsibility, and compensation for losses is a civil responsibility. They are different. In criminal incidental civil action, the death penalty cannot offset civil compensation.

After the criminal responsibility is determined, the victim can pursue the defendant's civil liability for compensation through civil litigation. However, if the defendant is an adult, criminal or civil liability shall be borne by him, and his relatives shall not punish or compensate him on his behalf. So if the victim is sentenced to death, he can only use his personal property to compensate. If personal property is insufficient, relatives have no legal obligation to compensate. Most death row inmates have no money, and the victims' economic losses cannot be compensated. Therefore, criminal offences are really harmful to others and themselves.
