Entrusted defense can be divided into three situations: (1) According to Article 33 of the Criminal Procedure Law, the defendant in a private prosecution case has the right to entrust a defender to defend himself at any time. (2) The criminal suspect in a public prosecution case has the right to entrust a defender from the date when the case is transferred to the People's Procuratorate for examination and prosecution. For a case directly accepted by the people's procuratorate, the criminal suspect has the right to entrust a defender from the date when the criminal investigation department of the people's procuratorate transfers the case to the examination and prosecution department. In this regard, the criminal suspect and his legal representative have the right to ask the organ in charge of case investigation or the relevant people's procuratorate whether the investigation has ended or whether the case has been transferred to the people's procuratorate for review and prosecution, and the relevant authorities shall truthfully inform them. The people's procuratorate shall, within 3 days from the date of receiving the case materials transferred for examination and prosecution, inform the criminal suspect that he has the right to entrust a defender. (3) According to Item 2 of Article 15 1 of the Criminal Procedure Law, if the defendant fails to appoint a defender before the opening of the court session 10, the people's court shall inform the defendant that he can appoint a defender, that is, the defendant has the right to appoint a defender.
Legal objectivity:
Article 61 of the Civil Procedure Law stipulates that the parties and their legal representatives may entrust one or two persons as agents ad litem. The following persons may be entrusted as agents ad litem: (1) lawyers and grassroots legal service workers; (2) Close relatives or staff members of the parties concerned; (three) citizens recommended by the community, units and relevant social groups where the parties are located. Article 52 A party has the right to entrust an agent to apply for withdrawal, collect and provide evidence, debate, request mediation, file an appeal and apply for enforcement. The parties may consult the relevant materials of this case and copy the relevant materials and legal documents of this case. The scope and methods of consulting and copying relevant materials in this case shall be stipulated by the Supreme People's Court. The parties must exercise their litigation rights in accordance with the law, abide by the litigation order, and perform legally effective judgments, rulings and conciliation statements.
