Matters needing attention in criminal lawyer's power of attorney

Entrusting a lawyer to represent a lawsuit does not necessarily require signing an agency contract with a lawyer, but an agency contract with a law firm, which will clearly stipulate the rights and obligations of both parties. Entrusting a lawyer to handle litigation matters requires signing a power of attorney with the lawyer. When representing litigation affairs, lawyers must submit a power of attorney to the court. Not signing is illegal and controversial.

Legal basis:

Article 25 of the Lawyers Law of People's Republic of China (PRC) * * * lawyers shall be entrusted by the law firm, sign a written entrustment contract with the client, collect fees in accordance with state regulations, and record them truthfully. Law firms and lawyers shall pay taxes according to law.

Article 59 of the Civil Procedure Law of People's Republic of China (PRC) * * * entrusts others to represent the litigation, and a power of attorney signed or sealed by the client must be submitted to the people's court. The power of attorney must specify the entrusted matters and authority. An agent ad litem must have the special authorization of the client, and can admit, waive or change the claim, make a settlement, file a counterclaim or appeal on his behalf.
