What are the key points of the lawyer qualification examination?

Workers who meet the registration conditions (refer to the "Lawyer Qualification Examination Measures") must register with the local judicial administrative agency with their identity certificate, academic certificate (with original and copy) and recent one-inch bareheaded photos (three photos).

Measures for the Lawyer Qualification Examination

Article 5 Persons who meet the following conditions may register for the Lawyer Qualification Examination:

(1) Support the Constitution of the People's Republic of China, Enjoy the right to vote and stand for election;

(2) Have full capacity for civil conduct;

(3) Obtain a college degree or above in law from a university or equivalent professional level, non-law major from a university Bachelor degree or above;

(4) Good conduct.

Article 6: Anyone who has any of the following circumstances shall not register to take the lawyer qualification examination. If the registration formalities have been completed, the registration shall be invalid:

(1) No capacity for civil conduct or limited civil capacity Capacity;

(2) Having received criminal punishment for intentional crimes;

(3) Being dismissed from public office;

(4) Being disqualified as a lawyer of.

Article 7 Applicants should fill in the registration form truthfully and submit the following materials when registering:

(1) Original and copy of academic certificate;

(2) Original and copy of ID card;

(3) Household registration certificate.

Persons who are not registered at their place of residence shall submit a temporary residence permit issued by the public security authority at the place of registration.

Article 8 Applicants shall pay the registration fee when registering.

The registration fee standards are determined by the justice departments (bureaus) of each province, autonomous region, and municipality directly under the Central Government in conjunction with the fee management departments at the same level. The registration fee should be used exclusively for examination expenses.

Article 25: The Ministry of Justice shall establish a leading group for the evaluation work to be responsible for organizing the evaluation work. The Ministry of Justice may entrust relevant units to undertake the examination paper evaluation work.

Article 26 The grading unit shall choose a closed and quiet place to set up the grading place, and assign security personnel to be responsible for safety work; except for the grading personnel, no other personnel shall enter the grading place.

Article 27 The grading personnel shall be selected by the grading unit from those who meet the following conditions:

(1) He or his close relatives have not participated in the lawyer qualification examination this year;

(2) Have a bachelor’s degree in law or above.

Article 28 The grading personnel shall abide by the disciplines of grading work and perform their duties in accordance with the grading rules.

Article 29 Paper review, scoring review and scoring registration shall be undertaken by dedicated personnel respectively.

After the grading work is completed, the Ministry of Justice will notify the judicial departments (bureaus) of each province, autonomous region, and municipality directly under the Central Government of the examination results in writing. Each city (prefecture) judicial administrative agency should notify candidates by email within 10 days after receiving the test results.

Article 31 If candidates have questions about their scores, they may submit a written application for score inquiry to the judicial administrative agency at the place of registration within 10 days after receiving the test score notification, but they may not apply to review or re-evaluate the test papers.

Article 32 The justice departments (bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government shall promptly summarize and submit score verification applications to the lawyer qualification examination agency of the Ministry of Justice, and the Ministry of Justice shall organize unified verification.

Article 33: The grading and verification work shall be undertaken by the grading unit under the supervision of the Grading Leading Group of the Ministry of Justice. The score verification of the test paper is limited to the calculation, totaling and registration of the scores of each question on the test paper.

After verification, if there are errors in the calculation, totaling, and registration of test scores, they will be corrected after review by the grading leading group, and the original scores and corrected scores will be recorded.

After the score verification of Article 34 is completed, the Ministry of Justice will notify the judicial departments (bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government in writing of the verification results. The justice departments (bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government should notify candidates who apply for score verification within 15 days after receiving the notification.

Article 35: The lawyer qualification examination papers shall be destroyed by the marking unit six months after the date of the lawyer qualification examination in this year, after verification of scores.

Article 36 The Ministry of Justice shall determine and publish every year the number of lawyer qualifications awarded by this year's examination.

After the examination, the Ministry of Justice will admit lawyers according to the number of qualifications granted by the examination this year, and the lawyers will be ranked from high to low.

Candidates who pass the exam and meet the minimum admission score after score verification will be admitted and are not subject to the limit on the amount of lawyer qualifications granted by the exam stipulated in Article 36 of these Measures.

Candidates with a record of absence or zero test scores will not be admitted.

Article 38: Candidates whose test scores reach the admission score should go to the local judicial administrative agency to apply for lawyer qualifications within 15 days from the date of receiving the written notice of test results and submit the application form issued by the public security agency. No criminal record certificate. Failure to complete the application procedures within the time limit without justifiable reasons will be deemed as automatic abandonment.

If the candidate fails to provide an accurate mailing address and cannot be notified, the municipal (regional) judicial administrative agency will notify the applicant by way of announcement. If the applicant fails to apply for lawyer qualification within 20 days from the date of announcement, it will be deemed to have given up.

Article 39: The justice departments (bureaus) of each province, autonomous region, and municipality directly under the Central Government shall review the materials submitted by the admitted candidates and submit them to the Lawyer Qualification Examination Committee of the Ministry of Justice for review within 30 days.

Article 40: Candidates who meet or exceed the minimum admission score but do not meet the registration conditions stipulated in these Measures upon review shall not be granted lawyer qualifications.

Article 41 After receiving the materials submitted by all localities, the Lawyer Qualification Examination Committee of the Ministry of Justice shall complete the examination within 30 days and issue the certificates and lawyer qualification certificates to the judicial offices of all provinces, autonomous regions, and municipalities directly under the Central Government. The Lawyer Qualification Examination Office of the department (bureau) shall be responsible for issuing the certificates to candidates who pass the examination within 30 days.
