Can civil lawyers handle criminal cases?

Legal analysis: Yes, but not all criminal cases can be prosecuted separately. If the victim of a criminal case has suffered material losses, and the plaintiff cannot make up for the losses through criminal recovery or restitution procedures, the plaintiff may file a criminal incidental civil action. If the criminal case has been closed, the plaintiff may file a separate civil lawsuit.

Legal basis: Article 28 of the Lawyers Law of People's Republic of China (PRC) may engage in the following businesses:

(a), accept the entrustment of natural persons, legal persons or other organizations, as legal advisers;

(two), to accept the entrustment of the parties in civil cases and administrative cases, as agents, to participate in litigation;

(3) Accepting the entrustment of a criminal suspect or defendant in a criminal case or a defender appointed by a legal aid institution according to law, and accepting the entrustment of a private prosecutor in a private prosecution case, a victim in a public prosecution case or their close relatives to participate in the litigation as an agent;

(four), entrusted to represent all kinds of litigation cases;

(five) to accept the entrustment and participate in mediation and arbitration activities;

(6) Accepting entrustment to provide non-litigation legal services;

(seven) to answer questions about the law and write litigation documents and other documents related to legal affairs.
