(1) Fees for civil cases are determined based on the trial stage. 1. Charges per piece are 2,000-10,000 yuan per piece if there is no property relationship involved. 2. The charging rate is determined according to the proportion of the target amount. For the part below 100,000 yuan (including 100,000 yuan), the fee is 3,000-5,000 yuan; for the part between 100,000 yuan and 1 million yuan (including 1 million yuan), 3-5%; for 1 million yuan For the amount up to 10 million yuan (including 10 million yuan), the handling fee is 2-4%; for the amount between 10 million yuan and 50 million yuan (including 50 million yuan), the handling fee is 1-3%; for the amount above 50 million yuan, the handling fee is -2 %. The difference in the disputed amount will be charged progressively according to the case. (2) If risk agency fees are implemented, the maximum fee amount shall in principle not be higher than 30% of the property rights agreed with the client. (3) Retrial, appeal, and enforcement cases shall be charged according to the lawyer service fee standards determined at the first instance stage.
II. Guidance Standards for Charges in Criminal Cases (1) Charge standards for criminal cases shall be determined on a case-by-case basis according to the stages of the case. 1. In the investigation stage, the fee for each case is 3,000-15,000 yuan. 2. In the review and prosecution stage, the fee for each case is 5,000-20,000 yuan. 3. In the first instance stage, the fee for each case is 5,000-30,000 yuan. (2) For second instance, death penalty review, retrial, appeal cases and criminal private prosecution cases, lawyer service fees shall be charged according to the charging standards at the first instance stage. (3) If the victim files a civil lawsuit attached to a criminal case, the lawyer's service fee shall be charged according to the charging standards for civil litigation cases. If a criminal case involves the amount of fees, it may be charged according to the fee standards for civil cases. (4) If a criminal suspect or defendant is involved in several charges or criminal facts at the same time, the charges shall be charged separately according to the charges or criminal facts involved.
3. Fee standards for administrative cases and state compensation cases (1) The fee standards for administrative cases and state compensation cases are determined based on piecework at each trial stage. (2) The piece-rate charging standard is 3,000-20,000 yuan per piece. (3) If property relations are involved, the amount can be calculated and collected according to the subject amount as in civil cases.
4. Annual or special legal advisory fees shall be negotiated between the law firm and the client. During the period when lawyers serve as legal advisors for the above-mentioned types of cases, they will be charged separately according to the legal service charging standards for each type of case.
5. Hourly charging standard: 100 yuan-3,000 yuan/effective working time. When lawyers handle legal matters, the necessary traveling time and preparation time are halved and included in the effective working time.
5. The following legal services must be agreed upon between the law firm and the client, and shall not be charged more than five times the prescribed charging standards: (1) The legal relationship is complex and the workload of the lawyer's services is significantly higher than that of similar businesses. ; (2) Involving difficult or professional issues that require lawyers to have significantly higher professional standards than similar businesses; (3) Major foreign-related legal services or legal services with significant social impact; (4) Other major, difficult, and complex legal services affairs.
