Provisions of the Standing Committee of Benxi Municipal People's Congress on discussing and deciding on major issues

Article 1 In order to ensure the Standing Committee of the Municipal People's Congress to exercise its functions and powers to discuss and decide major issues according to law, these Provisions are formulated in accordance with the relevant provisions of the Constitution of People's Republic of China (PRC), the Organic Law of Local People's Congresses and Local People's Governments at Various Levels in People's Republic of China (PRC) and the actual situation of this Municipality. Article 2 The following major issues shall be discussed, decided or deliberated and approved by the Standing Committee of the Municipal People's Congress according to law: (1) Important measures to ensure that the Constitution, laws, regulations and resolutions of the people's congresses at higher levels and their standing committees are observed and implemented within their respective administrative areas;

(2) the construction of socialist democracy and legal system, the rule of law and the formulation of local laws and regulations;

(3) the implementation of the work plan of governing the city according to law by the Municipal People's Government, the Municipal Intermediate People's Court and the Municipal People's Procuratorate;

(4) major issues in maintaining social stability, safeguarding national and collective interests and the legitimate rights and interests of citizens, legal persons and other organizations;

(5) political and economic system reform within their respective administrative areas and major reform plans involving the vital interests of the people;

(6) an important plan for economic restructuring;

(7) the overall plan for opening to the outside world;

(8) major issues in education, science, culture, health, sports, civil affairs, nationality, etc.;

(9) Partial changes to the annual plan for national economic and social development;

(1) city-level budget adjustment plan;

(11) financial annual accounts of the city at the corresponding level;

(12) to revoke inappropriate resolutions and decisions of the people's congresses of autonomous counties and districts and their standing committees;

(13) Revoking inappropriate decisions and orders of the Municipal People's Government;

(14) The chief procurator of the Municipal People's Procuratorate disagrees with the decision of the majority of the procuratorial committee on major issues and submits it for decision;

(15) When the Municipal People's Congress is not in session, arrest, put on criminal trial and take other measures to restrict personal freedom as prescribed by law;

(16) establishing sister cities with foreign countries;

(17) conferring or revoking local honorary titles;

(18) determine the city emblem, city tree and city flower;

(nineteen) matters submitted to the Municipal People's Congress for deliberation and decision;

(twenty) other matters that need to be discussed and decided by the Standing Committee of the Municipal People's Congress. Article 3 The following major issues shall be reported to the Standing Committee of the Municipal People's Congress, and the Standing Committee of the Municipal People's Congress may make corresponding resolutions and decisions when necessary:

(1) The implementation of the resolutions and decisions of the Standing Committee of the Municipal People's Congress and the implementation of the deliberation opinions;

(2) the implementation of the national economic and social development plan and budget;

(3) the budget, final accounts, management and use of extra-budgetary funds at the municipal level;

(four) the handling of suggestions, criticisms and opinions put forward by the representatives of the Municipal People's Congress;

(5) the implementation of the Constitution, laws and regulations and the organization of law enforcement inspection;

(6) Important information on population and family planning, land management, environment and resource protection;

(7) the establishment and implementation of key construction projects that have a significant impact on economic development, urban construction, environment and resource protection;

(8) the use of urban construction funds;

(9) the revision plan of the overall urban planning;

(1) Adjust the price standards of services such as water, electricity, gas, medical care, housing and public transportation, and adjust the charging items for students, farmers and enterprises;

(11) revenue and expenditure management of education funds, social security funds, poverty alleviation funds and housing accumulation funds;

(12) Sudden events with strong social repercussions, accidents that cause great damage to the lives and property of the state, collectives and people, involving natural disasters in the city and their handling;

(13) Important information about administration by administrative organs according to law and justice by judicial organs;

(14) the construction of clean government in local state organs and the handling of illegal personnel elected or appointed by the Municipal People's Congress and its Standing Committee;

(15) prosecution and trial of cases with serious harm, great influence and public concern;

(16) foreign exchange activities that have a significant impact on the economic and social development of this Municipality;

(17) Other matters that the Standing Committee of the Municipal People's Congress thinks should be heard. Article 4 The following major issues shall be submitted for approval according to the examination and approval authority, and the opinions of the Standing Committee of the Municipal People's Congress shall be solicited, and copied to the Standing Committee of the Municipal People's Congress:

(1) the institutional reform plan of the Municipal People's Government;

(2) the establishment, alteration or cancellation of the committees, offices and bureaus of the Municipal People's Government;

(3) the adjustment and change of administrative divisions at or above the township level in this Municipality, and the planning for the establishment and change of ethnic autonomous areas. Article 5 The major issues that must be discussed by the Standing Committee of the Municipal People's Congress include:

The Presidium of the Municipal People's Congress decides to submit the bill to the Standing Committee of the Municipal People's Congress for deliberation; The motion put forward by the meeting of directors of the Standing Committee of the Municipal People's Congress; The Municipal People's Government, the Special Committee of the Municipal People's Congress, the Municipal Intermediate People's Court, the Municipal People's Procuratorate and the Standing Committee of the Municipal People's Congress shall be jointly composed of five or more members and submitted to the meeting of directors of the Standing Committee of the Municipal People's Congress for deliberation.
