If the perpetrator constitutes a crime of stirring up trouble, he shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance. The crime of stirring up trouble refers to the act of stirring up trouble in public places, creating troubles, beating and hurting innocent people, and arbitrarily provoking, bullying and undermining public order.
Sentencing standard of the crime of stirring up trouble;
1, if the parties beat others at will, resulting in bad circumstances;
2. Chasing, intercepting, containing, insulting or intimidating others, and the circumstances are bad;
3. Forcibly take or rob things, or arbitrarily damage or occupy public or private property, if the circumstances are serious;
