Defense business is the main business of lawyers in handling criminal cases. According to legal provisions, lawyers may be hired by defendants in public prosecution or private prosecution cases to provide them with legal advice, represent them in appeals and accusations, apply for bail pending trial, accept entrustment from criminal suspects or defendants or designations from the People's Court, and serve as defenders. 1. Lawyers serving as criminal defenders shall, based on facts and law, submit materials and opinions proving that criminal suspects and defendants are innocent, have minor crimes, or reduce or exempt them from criminal liability, so as to safeguard the legitimate rights and interests of criminal suspects and defendants. 2. Lawyers participating in litigation activities can collect and check according to the provisions of the Procedural Law.
Legal objectivity:
Article 40 of the Criminal Procedure Law: From the date the People's Procuratorate examines a prosecution case, defense lawyers may consult, excerpt, and copy case files. Other defenders may also consult, excerpt, and copy the above-mentioned materials with the permission of the People's Court or People's Procuratorate.
