He regards his son as a burden.

Defendant Yun Zhou, 28 years old, from Bijie City, Guizhou Province, went to work in Hai 'an on 20/00/00. Zhou Qinghua, his own son, was born to Yun Zhou and his ex-girlfriend in 2009.

Zhou Qinghua became a left-behind child shortly after his birth-after his parents divorced, his mother left to get married and his father went to Hai 'an to work. It was his grandmother who brought him up with great pains. Later, Yun Zhou organized a family in Hai 'an and gave birth to a daughter. On 20 13, someone proposed to adopt Zhou and live with him. However, due to the delay in adoption, Zhou Qinghua was sent back to his home in zhou yun. Yun Zhou and his wife have disputes from time to time because of their son's life and study. Yun Zhou thought that his son's poor performance affected his normal life and even took him as a burden. Cruelly, he even had the idea of killing Zhou Qinghua and defrauding life insurance.

2065438+February 2006, Yun Zhou purchased several insurances with different coverage for Zhou Qinghua and himself. To be on the safe side, Yun Zhou also searched online for ways to kill people who might cause the appearance of accidental death. He also bought mice and medicinal crucian carp for experiments, and put gas in gas tanks on the construction site for experiments. Yun Zhou even planned how to spend the money to defraud the insurance money after killing his son. He chose a second-hand BMW car online and signed up for a driving course.

He strangled his 7-year-old son himself.

On March 26th, 2006, around midnight 10, Yun Zhou, who worked in Ji Hu, Hai 'an County, lied to his workmates that he was dating his lover and left by motorcycle alone. At 1 the next morning, Yun Zhou went home, climbed over the courtyard gate and entered the kitchen, unplugged the hose of the gas cooker, and tried to poison Zhou Qinghua who was sleeping by the kitchen with gas. Yun Zhou turned off the valve of the gas tank, for fear that the noise of gas leakage would be discovered too loudly. Then he sneaked into his son's room and covered his mouth and nose with a quilt until the child died. Subsequently, Yun Zhou opened the gas tank valve again, faked the illusion of gas leakage and left the scene. At 3 o'clock in the morning, Yun Zhou came home, pretending to have accidentally discovered his son's gas poisoning, and told his family. Relatives who heard the news called the police.

Appraised by the physical evidence appraisal room of Hai 'an Public Security Bureau, the victim Zhou Qinghua died of mechanical suffocation due to being squeezed by others before his death. Appraised by the Judicial Appraisal Institute of Nantong Mental Health Center, the defendant Yun Zhou is not mentally ill and has full criminal responsibility.

The murder case was sentenced to death in the first instance.

In the court, the defendant Yun Zhou and his defense lawyer argued repeatedly that Zhou Qinghua was killed not to cheat insurance, but surrendered himself and should be given a lighter punishment.

The City Intermediate People's Court held that the judicial expertise inspection report issued by Shanghai Chen Xing Electronic Data Judicial Appraisal Center confirmed that zhou yun had inquired about the ways of killing, insurance, cars and other contents on the Internet in a short time, and that Yun Zhou, who was transferred by the public security organ to handle accident insurance, the insurance policy for the beneficiary, the application form for motor vehicle driver's license and the witness's testimony were enough to conclude that he killed his son in order to defraud insurance money. After the incident, Yun Zhou was questioned by the public security organs for his suspicious behavior. At first, he didn't tell the truth After the public security organs grasped his action track, obtained witness testimony and preliminarily judged the cause of death, Zhou Yun was listed as a major suspect. After many reviews, Yun Zhou confessed the crime truthfully, and his behavior did not meet the statutory conditions for surrender, which did not constitute surrender.

After trial, the Municipal Intermediate People's Court held that the defendant Yun Zhou, in pursuit of personal pleasure, attempted to kill his own son, then cheated insurance, and forged the scene of gas poisoning after committing the crime, which was extremely cruel and subjective and vicious, and should be severely punished. In order to maintain social public order and protect citizens' personal rights from infringement, the defendant Yun Zhou was convicted of intentional homicide, sentenced to death and deprived of political rights for life in accordance with the provisions of Article 232, Paragraph 1 of Article 48 and Paragraph 1 of Article 57 of the Criminal Law of People's Republic of China (PRC).
