How to write a commission contract

Legal analysis: 1. Party B accepts Party A’s entrustment and appoints lawyer XX as its first-instance litigation agent.

2. Party A must truthfully state the case to Party B’s lawyer and provide evidence or evidence clues related to the case. If Party A provides false facts and evidence, Party B has the right to terminate the agency and the fees as agreed in the contract will not be refunded.

4. Party B’s lawyer must conscientiously complete all activities, appear in court on time, and safeguard Party A’s legitimate rights and interests.

5. According to the provisions of the "Measures for the Administration of Fees for Lawyer Fees" of the State Planning Commission and the Ministry of Justice, Party A shall pay Party B an agency fee of RMB xxx yuan, which shall be paid within five days after the signing of this contract. If the fee is negotiated, a separate fee agreement shall be signed, which shall be an integral part of this contract.

6. If Party A fails to pay the agency fee on time or fails to pay the agency fee in full, Party B has the right to terminate this contract, suspend the agency work, and resume performance of this contract after Party A pays off the agency fee.

Party A shall bear the travel and transportation expenses incurred by Party B’s lawyers during the agency work.

7. If Party B terminates the performance of this contract without reason, the agency fee will be refunded to Party A; if Party A unilaterally terminates the entrustment or cancels the case, the agency fee will not be refunded.

8. This contract is valid from the date of signing until the conclusion of the case (including: judgment, conclusion of ruling, conclusion of mediation, out-of-court settlement and withdrawal of lawsuit). If a lawyer continues to be retained during the second instance, retrial, or enforcement proceedings, a separate agency contract will be signed and fees will be charged.

9. The two parties will negotiate on the contract dispute in this case; if the negotiation fails, the arbitration decision will be made by the XXX Arbitration Commission.

Legal basis: "Article 59 of the Civil Procedure Law of the People's Republic of China" If someone entrusts another person to litigate on his behalf, a power of attorney signed or sealed by the client must be submitted to the People's Court.
