What is the sentencing standard for intentional injury?

According to Article 384 of the Criminal Law of the People's Republic of China, anyone who intentionally harms the body of others shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, or public surveillance. Anyone who causes serious injury to another person shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; whoever causes death or serious injury resulting in severe disability by particularly cruel means shall be sentenced to fixed-term imprisonment of not less than ten years but not more than ten years, or life imprisonment or death.

1. Anyone who intentionally harms the body of others shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or surveillance.

2. Anyone who intentionally injures another person's body and causes serious injury shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years. The "serious injury" here, according to the provisions of Article 96 of the Criminal Law, refers to one of the following circumstances: (1) causing disability or disfigurement; (2) causing the person to lose hearing, vision or other organ functions ; (3) Other serious harm to personal health. The so-called "other major harm to personal health" mainly refers to injuries that are life-threatening when the above-mentioned injuries occur, or life-threatening complications that may occur during the injury process, as well as other injuries that seriously affect human health, including craniocerebral injuries. Injuries, neck injuries, chest injuries, abdominal injuries, pelvic injuries, spine and spinal cord injuries and other injuries that seriously affect human health. Brain injury, neck injury, chest injury, abdominal injury, pelvic injury, spinal and spinal cord injury, as well as injuries caused by burns, scalds, frostbite, electrical injuries, physical, chemical or biological injuries, etc. On March 29, 1990, the Ministry of Justice, the Supreme People's Court, the Supreme People's Procuratorate, and the Ministry of Public Security issued the "Standards for the Assessment of Serious Injuries." In judicial practice, the identification of serious injuries is mainly based on the "Standards for Identification of Serious Human Injury".

3. Whoever intentionally injures someone causing death, or uses particularly cruel means to cause serious injury or severe disability, shall be sentenced to fixed-term imprisonment of not less than ten years, life imprisonment, or death. "Causing death" here refers to the behavior in which the perpetrator harms others with the intention of harming their health, but the victim dies due to the lack of timely and effective treatment after the injury or other reasons. "Especially cruel means" refers to the behavior of injuring others with particularly cruel means such as disfiguring, gouging out eyes, cutting off feet, etc., with the intention of causing serious disability to others.
