Conditions for applying for the lawyer qualification certificate
There is no requirement that you must be a full-time undergraduate to take the lawyer qualification certificate exam.
Educational requirements: Bachelor’s degree or above in law from an institution of higher learning, or bachelor’s degree or above in other majors from an institution of higher learning, with professional legal knowledge.
In other words, in principle, junior college students cannot register for the national judicial examination. However, this year the Ministry of Justice stipulated that in some areas where there is a serious shortage of legal talents, the qualifications for judicial examination registration are still relaxed, allowing legal Professional junior college students register in relaxed areas.
Measures for the Implementation of the National Judicial Examination
Article 15 Those who meet the following conditions may register for the lawyer qualification examination:
(1) Have Chinese nationality;
(2) Support the Constitution of the People’s Republic of China and enjoy the right to vote and be elected;
(3) Have full capacity for civil conduct;
(4) College of Law Those who have graduated from a bachelor's degree or majored in non-laws from a higher education institution and have legal expertise;
(5) Have good conduct.
If you have any of the following circumstances, you cannot register to take the exam. If you have gone through the registration procedures, your registration will be invalid:
(1) Those who have received criminal punishment for intentional crimes;
(2) Being dismissed from public office by a state agency or having a lawyer's practicing license revoked;
(3) Being sentenced in accordance with the provisions of Article 18 of the "National Judicial Examination Implementation Measures (Trial)" Those who are not allowed to register for the National Judicial Examination for 2 years and the period has not expired; or are sentenced to life-long ban from registering for the National Judicial Examination.
2. Application materials for lawyer qualification certificate
When confirming on-site, the applicant must submit the following materials:
1. Original second-generation resident ID card and a copy.
Applicants who have not received a second-generation resident identity card can use a first-generation valid resident identity card. Active-duty military personnel who have not received a second-generation resident ID card can use an officer's ID card or a soldier's ID card.
Applicants holding a passport must submit a valid identity document or household registration certificate in addition to their passport.
2. Original and copy of my academic certificate.
Undergraduate graduates from ordinary colleges and universities must submit a format certificate issued by their school (the format certificate can be downloaded from the Ministry of Justice website) and their student ID card.
To apply for a graduation (degree) certificate from a higher education institution in Hong Kong, Macao, Taiwan or abroad, you must submit the graduation (degree) certificate issued by the Study Abroad Service Center of the Ministry of Education and its copy.
3. If the household registration is in a place where registration qualifications are relaxed and local policies are relaxed, the original and copy of the household registration book (printed version) must be submitted; the household registration code filled in the registration form should be consistent with the household registration place.
4. Other materials required by judicial administrative agencies.
After review by the judicial administrative authority at the place of registration, if the registration materials are confirmed to be true and complete, meet the registration conditions, and the examination fee has been paid, the main admission ticket will be issued. Those who pass the review by the provincial judicial administrative agency are allowed to generate supplementary certificates for the admission ticket. Applicants can download the supplementary certificate of admission ticket from the website of the Ministry of Justice.
Candidates must hold both the main and supplementary admission tickets to take the exam.
