What makes you give up and forget yourself?
After the sixth "Top Ten Outstanding Prosecutors in China" was announced, the "Top Ten" became the focus of people's attention. Ten stars in the entertainment circle have zero-distance contact with the "Top Ten Masters" through Justice Network ... Lin Yilun v. Wang Shutian (Deputy Procurator-General of Lintong District People's Procuratorate, Xi City, Shaanxi Province) selling a house for medical treatment. What was your mood at that time? I really didn't want to sell the house at that time. First, I have deep feelings for this house, because I built the whole building. Second, my illness is so serious that I may not be able to speak. This house is the only valuable property I can leave to my wife and daughter. But in order to treat me, the house still insists on selling. Sell it. It's no big deal. Many people in China have difficulties and are trying to overcome them. Why can't I overcome it myself? What do you want your daughter to do in the future? I don't really think about what she will do in the future. Even if I have my idea, it may not be to her liking. I just hope that she has something to do, that she can be self-reliant and do something beneficial and contributing to society. Besides, what to do depends on whether she has this ability. You used to be a policeman and a prosecutor. Have you ever beaten those criminals? More than 20 years ago, a criminal suspect was very dishonest. I was angry and kicked him. The result was seen by a leader. He didn't say anything, so he asked me. I feel ashamed. Since then, I have never touched a finger of the suspect. We must protect human rights according to law and enforce the law in a civilized way. David vs Jiang Hansheng (Prosecutor of Public Prosecution Department of Henan Provincial People's Procuratorate) How did you find the wrong case? Do you have any suggestions? Xu Jingxiang's case was discovered by accident when I was reviewing a case of a police officer practicing favoritism and malpractice. At that time, the lower procuratorate thought that the police officer was shielding Xu Jingxiang. To find out what happened, I read Xu Jingxiang's file. During the examination, I found that the police officer did not tell a lie, and the case was a typical misjudged case. The so-called trick is to be fair, responsible and careful when performing your duties. It took you seven years to correct a wrong case. Have you ever thought about giving up? I didn't expect it to take so long at first, but I thought it would be corrected soon. However, with the development of the work, it is found that there is great resistance, and every step forward is very difficult. But this kind of difficulty can't be compared with Xu Jingxiang's personal and family sufferings 13 years. Responsibility and conscience urged me to persist in doing it. The more difficult and meticulous, I must make it. With the strong support of the organization, the procuratorate overcame the resistance and took the initiative to find and correct this misjudged case. What is the law in your mind? The law is fair and equal. Law enforcers should strictly abide by the law, handle each case fairly and treat each party equally. Chen Hao vs Wu Chunmei (Prosecutor of Public Prosecution Division 2, No.2 Branch of Beijing People's Procuratorate) Have you ever been afraid of criminals? To tell the truth, so far, although I sometimes feel stressed, I have never felt afraid in handling cases. You have to be eloquent as a prosecutor, okay? Of course, prosecutors should have good eloquence, which is a basic skill, but good eloquence is closely related to a solid theoretical foundation, familiarity with cases and laws and regulations, and persistent pursuit of beliefs and ideals. Otherwise, even the best eloquence will not be reflected. There are many people with good eloquence. It cannot be said that everyone can be a prosecutor, let alone a good prosecutor. Do you like shopping? Shopping is a very feminine thing, and I am naturally very feminine, so I will go shopping when I rest. I used to like shopping directly. For example, I bought a battery and went directly to the supermarket to buy it and left. Now that I have children, I am willing to go shopping when necessary. Feng Xiaoquan vs Chen Simin (Procurator-General of the People's Procuratorate of Haizhu District, Guangzhou City, Guangdong Province), have you ever encountered a stressful case? In handling cases, especially when dealing with duty crimes, we have encountered cases with relatively high pressure. In this case, I often think of two words-"crisis". It is said that the most dangerous time is also the time with the greatest opportunity. We are not complaining, but studying how to turn pressure into motivation and make the case more beautiful. Over the years, we have really developed a set of methods and means to turn pressure into motivation. For example, if someone intercedes, we sum up the "eight methods of intercession" and in turn mobilize the criminal suspect to plead guilty. Is the "index management" mechanism you created applicable to other procuratorates in China? The "index management" mechanism created by our Haizhu District Procuratorate has achieved quite good results and played a very important role in team building. If the mechanism is popularized nationwide, the most important thing is to make targeted modifications and adjustments in combination with the characteristics and actual conditions of hospitals, so as to have an effect. Who are you most grateful for winning the title of "Top Ten Outstanding Prosecutors"? The most grateful person should be the mother. There are two meanings in this. My mother is the one who gave birth to me, and my mother is also the one who raised me. We often compare our motherland to our mother, who is the greatest, the most respectable and the most grateful. Damai v. Wang Bingxiang (Procurator-General of People's Procuratorate of Jinghai County, Tianjin) How does the procuratorial organ protect the lawyer's right to practice? According to the law, procuratorial organs can protect lawyers' right to practice in criminal proceedings in several aspects, such as meeting the parties, meeting criminal suspects, consulting relevant files, and ensuring lawyers' defense responsibility in court debates. Some units send money and things to officials for development. Does this count as seeking illegitimate interests? Is it a bribe? This kind of behavior is an act of seeking illegitimate interests and should be recognized as a crime of bribery. These units give things and money for a certain benefit, which is an act of legal person or small group bribing state functionaries, and should be regarded as legal person bribery. Do family members complain at ordinary times? How did you handle it? Do more ideological work for family members, comfort them, and spend as much time with them after work as possible. Jiang v. Wang Hongri (Procurator-General of the People's Procuratorate of Haicheng City, Liaoning Province) You are a doctor of law. How do you reconcile the contradiction between work and study? In fact, work and study are both contradictory and unified. With a solid theoretical foundation, work efficiency can be improved, so learning can promote work. To coordinate the contradiction between work and study, my important method is to strengthen the concept of time and form a good habit of planning everything. Do you feel the contradiction between theory and practice? Procuratorial work is very professional and needs a solid theoretical foundation of law. When there is a contradiction between theory and practice, we should proceed from reality and pay attention to the unity of the legal effect and social effect of the case. Do you have a lot of spare time? What kind of entertainment do you usually have? Not rich, but full, mainly reading books and playing tennis. Besides, I like watching your roles, such as Wang Jingwen in Black Ice. Mei Ting vs Wei Yanling (Deputy Chief of Investigation and Supervision Department of Mishan People's Procuratorate, Heilongjiang Province), how is your health recently? Take care of yourself! I have been fine recently, but I have a little cold these days. Thank you for your concern. At the same time, I also take this opportunity to express my heartfelt thanks to the national procuratorial organs and all walks of life for their care and help. I want to say that the lives they saved did not live up to their hopes. What do you do after work? I like to go for an outing and see the mountains and beautiful nature. Then I like reading books, improve my professional level and cultivate my sentiment. You are in financial difficulties, but you refuse to pay tens of thousands of yuan. Have you ever regretted it? I have never regretted it, because my second life was given by the party and the people, and the power in my hands was also given by the party and the people. How can I change these into money? * * * party member's party spirit and prosecutor's duty don't allow me to do this. Sun Li vs Rui (Deputy Director of Anti-corruption and Bribery Bureau of Changning District People's Procuratorate), has anyone ever bribed you? There are also people who trust others in handling cases, but our procuratorial organs have a strict reporting system and should report them step by step. Someone invited me to dinner and gave me a gift, but we couldn't accept it and refused on the spot. If you can't refuse, take it back and send it to the discipline inspection department for registration. Do you think corruption can be eradicated after long-term anti-corruption? This is a complicated problem. To achieve the effect of eradication, we should not only rely on cracking down, but also rely on comprehensive management, which requires the cooperation of various social institutions and mechanisms. Through comprehensive management, temporary solution and permanent cure, through ideological education system constraints, system constraints. Through strike hard, anti-corruption has achieved initial results. If we can crack down in stages, coupled with governance in all aspects of society, the goal of eradicating corruption will be very close. Do you like watching movies? Who is your favorite star? I seldom go to the movies. But recently I watched a TV series "Bright Sword", in which the hero Li Youbin, I like it very much. If there is an anti-corruption masterpiece that can reflect the anti-corruption theme, I think Li Youbin should be the protagonist. Liang Jian's spirit is also a portrayal of handling cases, and we should also carry forward Liang Jian's spirit. Hu Jun v. Wang Lianfeng (Procurator-General of the Naval Military Procuratorate of the Chinese People's Liberation Army): Have you ever met a superior leader in handling a case, and how would you handle it? The intercession I encountered in handling cases did not come from superiors, but mostly from criminal suspects and their families. Faced with this situation, I will take the initiative to report it in time to make the criminal evidence more conclusive. If prosecutors want to be completely detached, do they have to be greatly restricted in social activities and have few friends? Made a lot of friends by handling cases. First, the people in the unit where the case occurred, they realized the support from ignorance and formed a friendship; Second, people who have helped us handle cases; Third, many criminal suspects and their relatives are willing to make friends with me. But I am quite cautious about making friends in society. All my friends have helped me in different ways in my life. Do you have any hobbies? I like amateur creation, write some legal articles and occasionally read novels. I like sports, and I like watching the "three big balls" game best. I'll take a break during the case. Ceng Gege vs Li Meilan (Deputy Procurator-General of Zhaoyuan People's Procuratorate): What makes you devote yourself to your work? I am an ordinary grass-roots prosecutor. The procuratorial work I am engaged in is a bridge and link between the procuratorial organs and the people. One end is connected with the sufferings of the people, and the other is connected with social stability. I was born in the countryside and work at the grassroots level. The cases I handle directly face the masses and have a natural special complex for them. So I have more understanding and care. It is my bounden duty to do everything possible to provide convenience for the people, uphold justice and do practical things. Do you have more time to spend with your family besides heavy work? Little, little time to spend with my family. I feel guilty about it, too.
