Regulations on the Protection and Management of Ancient Tea Trees in Shuangjiang Lahu, Wa, Bulang and Dai Autonomous County, Yunnan Province

Article 1 In order to strengthen the protection of ancient tea trees, these regulations are formulated in accordance with the "Regional Ethnic Autonomy Law of the People's Republic of China" and the "Regulations on the Protection of Precious Tree Species of Yunnan Province" and in combination with the actual situation of the autonomous county. Article 2 The ancient tea trees mentioned in these regulations refer to wild ancient tea trees, wild related ancient tea trees and cultivated ancient tea trees distributed in autonomous counties. Article 3 The protection scope of ancient tea trees includes: wild ancient tea tree communities in the Mengku Snow Mountain; wild ancient tea tree communities in Shahe, Mengmeng, Dawen, Bangbing and other places; ancient tea gardens cultivated in Iceland and other places; scattered ancient tea trees.

The people's government of the autonomous county shall set up boundary markers or protection signs within the protection scope of ancient tea trees and make an announcement. Article 4 Ancient tea trees are precious resources of the autonomous county and belong to the national second-level precious tree species. The autonomous county implements the policy of strengthening protection, overall planning and rational utilization of ancient tea trees. Article 5 Within this administrative region, all units and individuals must abide by these regulations. Article 6 The people's government of the autonomous county shall establish an ancient tea tree protection and management agency and staff it with full-time management personnel to be responsible for the protection and management of ancient tea trees. Its main responsibilities are:

(1) Promote, implement and enforce relevant laws, regulations and these regulations;

(2) Formulate protection and management measures and organize them after approval by the Autonomous County People's Government Implementation;

(3) Establish boundary markers and signs within the scope of protection and management;

(4) Investigate, monitor and establish files on ancient tea tree resources;

(5) Organize and assist scientific research units and individuals in conducting scientific research on ancient tea trees;

(6) Exercise the administrative law enforcement rights conferred by these regulations. Article 7 The autonomous county’s land and resources, water conservancy, environmental protection, public security, agriculture, tea office, science and technology, tourism, transportation, industry and commerce and other departments shall, in accordance with their respective responsibilities, do a good job in the protection and management of ancient tea trees.

The township (town) people's government and village committees where the ancient tea trees are located should cooperate in the protection and management of ancient tea trees. Article 8 The people's government of the autonomous county shall strengthen publicity and education on the protection and management of ancient tea trees. All units and individuals have the obligation to protect ancient tea trees and have the right to stop, report and prosecute acts that damage ancient tea trees. Article 9 The People's Government of the autonomous county shall establish special funds for the protection and management of ancient tea trees to be used for the protection, management and scientific research of ancient tea trees.

Main sources of funds:

(1) Financial allocation;

(2) Social donations and other funds. Article 10 The people's government of the autonomous county shall prepare an ancient tea tree protection plan and utilize ancient tea tree resources to develop tourism. When developing scenic spots and scenic spots and determining tourist routes within the protection scope of ancient tea trees, the tourism administrative department shall seek the opinions of the ancient tea tree protection and management agencies and handle the approval procedures in accordance with relevant regulations. Article 11 The People's Government of the autonomous county encourages various organizations and individuals to conduct scientific research and rational development and utilization of ancient tea trees. Article 12 The following activities within the protection scope of ancient tea trees must be approved by the forestry administrative department at or above the county level: (1) Scientific research, photography and exploration;

( 2) Collect ancient tea tree roots, stems, leaves, flowers and fruits;

(3) Collect ancient tea tree seedlings and transplant ancient tea trees. Article 13 The following behaviors are prohibited within the protection scope of ancient tea trees:

(1) illegally felling trees and peeling bark;

(2) deforestation, mining, soil extraction, construction House and grave repair;

(3) Bee collecting and collecting parasites or epiphytes on trees;

(4) Hunting and picking included in national and provincial protection lists wild animals and plants;

(5) Using fire in the wild;

(6) Carving and painting on ancient tea trees;

(7) Destroying ancient tea trees Protect signs and facilities;

(8) Plant crops and trees that have an impact on ancient tea trees;

(9) Use chemical fertilizers and pesticides on ancient tea trees. Article 14 The People's Government of the autonomous county shall commend and reward units and individuals that have made outstanding achievements in the protection and management of ancient tea trees. Article 15 Anyone who violates the provisions of these Regulations and commits any of the following acts shall be ordered by the ancient tea tree protection and management agency to cease the illegal acts and be given administrative penalties; if a crime is constituted, criminal liability shall be pursued in accordance with the law.

(1) Violation of Article 12, Items (1), (2), Article 13, (3), (5), (6) and Article 13 Those specified in items (7), (8), and (9) shall be fined 100 yuan.

(2) Anyone who violates the provisions of Article 13 (2) and (4) shall be fined not less than 500 yuan but not more than 5,000 yuan;

(3) Violation of Article 12 Those who violate Article 13, Item (3) shall be fined not less than RMB 1,000 but not more than RMB 10,000; (4) Those who violate Article 13, Item (1) shall have their illegal gains confiscated and shall be fined for illegal logging and destruction. A fine of not less than three times but not more than five times the value of the forest trees will be imposed. Article 16 If the party concerned is dissatisfied with the administrative penalty decision, the matter shall be handled in accordance with the relevant provisions of the "Administrative Reconsideration Law of the People's Republic of China" and the "Administrative Procedure Law of the People's Republic of China". Article 17 If the staff of the ancient tea tree protection and management agency and relevant departments in the autonomous county abuse their power, neglect their duties, engage in malpractice for personal gain during the protection and management of ancient tea trees, they shall be given administrative sanctions by their unit or the superior administrative department; if it constitutes a crime, Investigate criminal liability in accordance with the law.
