Article 1: In order to promote funeral reform, strengthen funeral management, and promote the construction of socialist material civilization and spiritual civilization, these measures are formulated in accordance with the "Interim Regulations on Funeral Management" of the State Council and in combination with the actual situation of our city.

Article 2: The Municipal Civil Affairs Bureau is the administrative department in charge of funeral management in the city.

The county (district) civil affairs bureau is responsible for the funeral management within its own administrative region.

The township (town) people's government, sub-district offices and their residents (village) committees are specifically responsible for matters related to funeral management.

The public security, industry and commerce, environmental protection, health, land, planning, price, ethnic and religious departments and other departments should cooperate with the funeral management department to strengthen the city’s funeral management work.

Article 3 Funeral management should adhere to the principle of actively and gradually promoting cremation and reforming burial. We advocate civilized and frugal funerals and oppose extravagant funerals. It is strictly prohibited to use funeral activities to engage in feudal superstitious activities.

Article 4 People’s governments at all levels, sub-district offices, residents’ committees, agencies, groups, enterprises and institutions should carry out extensive publicity and education on funeral reform among residents, employees and students.

Citizens have the right to report and expose violations of these Measures to the funeral management department, and no unit or individual may stop or retaliate. The funeral management department shall support and encourage the reporting of persons and behaviors that violate the provisions of these Measures, and provide appropriate rewards.

Article 5 In cities, mining areas, Chengguan Township in the southern suburbs and Zhoujiadian Village and Songzhuang Village in Ma Junying Township, the deceased should be cremated.

Article 6 In the cremation area stipulated in Article 5 of these Measures, those who die due to infectious diseases or die abnormally shall be cremated within three to seven days.

Those who die due to Class A infectious diseases shall be cremated within 24 hours.

No unit or individual may provide coffins, vehicles, cemeteries, or any other services to assist in burial or burial of ashes in coffins for the deceased who should be cremated in accordance with the provisions of paragraphs 1 and 2 of this article.

After the death of ethnic minority residents (villages) permitted by the state for burial, they should be buried in designated places. No one can interfere with voluntary cremation.

Article 7 In the cremation area, the health administrative department and the hospital should strengthen the management of the morgue and prohibit the burial of corpses outside. When the body is transported out of the hospital, it should have a "Cremation Certificate" issued by the Municipal Funeral Management Office.

Article 8 In areas where cremation is practiced, funeral institutions may establish commercial cemeteries to bury the ashes of residents (villagers) in the area. The construction unit shall apply to the civil affairs department at or above the county level to establish a commercial cemetery. After being reviewed and approved by the municipal planning administrative department and the people's government at the same level, it shall go through the approval procedures in accordance with relevant regulations. Without permission, no other unit may establish a commercial cemetery.

In non-cremation areas, public welfare cemeteries can be established. Applications for public welfare cemeteries shall be submitted by the village committee, and after review and approval by the county (district) civil affairs department, the land administration department shall handle the land use procedures in accordance with the law. The establishment of public welfare cemeteries in urban construction areas must be approved by the municipal planning administrative department. Public welfare cemeteries are not allowed to carry out business activities.

Article 9 When establishing a cemetery, barren hills and wasteland shall be selected, and cultivated land shall not be occupied. Cemeteries shall not be established within 200 meters around reservoirs and lakes or on both sides of rivers, dams, roads, and railways.

It is prohibited to establish family or religious cemeteries and engage in feudal superstitious activities in cemeteries.

Article 10 Units and individuals that produce and sell funeral supplies must be reviewed and approved by the municipal funeral management department and issued with the "Shanxi Province Funeral Products Production and Sales License" before they can apply to the industrial and commercial administration department. No unit or individual may produce or sell feudal superstitious funeral supplies.

In the cremation area, the production and operation of coffins is prohibited.

Article 11 It is strictly prohibited to place coffins, funeral utensils, and throw paper money and other debris along the road in cremation areas in urban streets and residential areas.

Article 12 The heirs of the deceased in the cremation area must hold the "Cremation Certificate" issued by the funeral home when receiving funeral expenses, insurance and other expenses. If there is no license, the issuing unit will not pay.

Article 13 Funeral management departments and service units should strengthen management, improve service items, and improve service quality.

Funeral management and service personnel must strictly enforce the law and act impartially. They are strictly prohibited from making things difficult for the family of the deceased, accepting property or extorting money.

Article 14 If the deceased is buried in the cremation area in violation of these regulations, the township (town) people's government of the place where the deceased is buried shall order the funeral parlor to cremate the deceased. If the person refuses to bear the burial expenses, the township (town) people's government shall report to the funeral management department within three days, and the funeral management department shall organize compulsory burial and cremation. In addition to bearing the expenses, the funeral director shall be fined not less than 3,000 yuan but not more than 8,000 yuan. A fine of less than RMB 10,000.

Article 15 Anyone who violates these Measures and falls under any of the following circumstances will have his/her illegal gains confiscated by the industrial and commercial administration department, his or her business license shall be revoked, and the person in charge of the unit and the person directly responsible shall be punished by the funeral and interment management department. A fine of not less than 2,000 yuan but not more than 5,000 yuan is imposed:

(1) Producing and operating coffins in the cremation area;

(2) Producing without obtaining the "Shanxi Province Production and Sales Funeral Supplies License" Selling funeral supplies;

(3) Producing and selling feudal superstitious funeral supplies.

Article 16 In case of violation of these Measures and any of the following circumstances, the funeral management department shall impose a fine of not less than 500 yuan but not more than 3,000 yuan on the person in charge of the unit and the person directly responsible:

< p>(1) Transporting the body out of the hospital without a "Cremation Certificate" in the cremation area;

(2) Providing coffins, vehicles, cemeteries, etc. for the burial of ashes and coffins in the cremation area.

Article 17 Any unit or individual that violates the provisions of Article 8 of these Measures and establishes commercial cemeteries or public welfare cemeteries without approval to carry out business activities shall be ordered by the funeral management department to cease business activities and confiscate illegal gains. , impose a fine of not less than 1,000 yuan but not more than 5,000 yuan on the person in charge of the unit and the person directly responsible.

Article 18 If anyone violates the provisions of Article 12 of these Measures and pays funeral expenses, insurance premiums and other expenses without a cremation certificate, the funeral management department will order the issuing unit to recover the money, and the person in charge of the issuing unit and the person responsible for the payment will be punished. The person directly responsible shall be fined not less than RMB 100 but not more than RMB 500.

Article 19 If any person violates these regulations and falls under any of the following circumstances, the funeral management department shall impose a fine of not less than 200 yuan but not more than 2,000 yuan on the funeral director:

(1) Those who died due to infectious diseases or abnormal deaths have been concluded by relevant departments and are not cremated within the prescribed time;

(2) Placing coffins, conducting funerals, and throwing paper money along the roads in urban streets and residential areas, etc. Sundries;

(3) Inviting gods, witches, and yin-yang masters to engage in feudal superstitious activities during the funeral period;

Article 20 Anyone who refuses or hinders funeral management personnel from performing their duties in accordance with the law shall be punished by the public security organs in accordance with Article 19 of the "Regulations on Public Security Administration Punishments of the People's Republic of China". Article 21 If any funeral management staff neglects their duties, pretends to be public for personal gain, or accepts bribes, they shall be criticized and administratively sanctioned by their competent departments; if the circumstances are serious enough to constitute a crime, the judicial authorities shall investigate criminal liability in accordance with the law.

Article 22 If the party concerned is dissatisfied with the penalty decision, he may, within fifteen days from the date of receipt of the penalty decision, apply for reconsideration to the administrative agency at the next higher level that made the penalty decision. A review decision shall be made within two months from the date of the review application; if the review applicant is dissatisfied with the review decision, he may file a lawsuit with the People's Court within 15 days from the date of receipt of the review decision; the punished person may also file a lawsuit with the People's Court within 15 days from the date of receipt of the review decision; the person who is punished may also file a lawsuit after receiving the penalty decision. File a lawsuit directly with the People's Court within three months.
