Legal analysis: (1) Treatment costs. The cost of treating work-related injuries must comply with the work-related injury insurance diagnosis and treatment item catalog, work-related injury insurance drug list, and work-related injury insurance hospitalization service standards.
(ii) Hospitalization meal allowance. If an employee is hospitalized due to a work-related injury, the employer shall pay hospitalization food subsidy at 70% of the unit's food subsidy standard for business trips.
(3) Transportation, food and accommodation expenses for overseas medical treatment. If an employee with a work-related injury is certified by a medical institution and approved by the handling agency to seek medical treatment outside the coordinated area, his or her transportation, food and accommodation expenses will be reimbursed by the unit in accordance with the standard for employees of the unit traveling for work.
(4) Rehabilitation treatment fees. If the expenses for rehabilitation treatment of a work-injured employee at a medical institution with which he has signed a service agreement comply with the "Work-Injury Insurance Diagnosis and Treatment Item Catalog", "Work-Injury Insurance Drug Catalog" and "Work-Injury Insurance Hospitalization Service Standards" stipulated in paragraph 3 of this article, the expenses shall be borne by the Work-Injury Insurance Company Fund payments.
Legal basis: "Article 30 of the "Regulations on Work-related Injury Insurance" of the People's Republic of China and the State. Employees who are injured in accidents due to work or suffer from occupational diseases are treated and enjoy medical treatment for work-related injuries.
< p>Work-related injury benefits are provided by medical institutions that have signed service agreements. In case of emergency, employees can first go to the nearest medical institution for first aid.The cost of treating work-related injuries is in line with the work-related injury insurance diagnosis and treatment item catalog and work-related injury insurance drugs. Catalog of work-related injury insurance diagnosis and treatment items, work-related injury insurance drug list, and work-related injury insurance hospitalization service standards shall be stipulated by the social insurance administrative department of the State Council in conjunction with the health administrative department and the food and drug regulatory department of the State Council.
The food subsidy for employees who are hospitalized for treatment of work-related injuries, as well as the transportation, food and accommodation expenses for employees to seek medical treatment outside the coordinated area, as certified by the medical institution and approved by the handling agency, shall be paid from the work-related injury insurance fund. Specific payment standards It shall be stipulated by the coordinating regional people's government.
