Criminal proceedings refer to the activities of public security organs, people's procuratorates and people's courts, with the participation of the parties and other participants in the proceedings, to verify whether the defendant has committed a crime, whether he should be punished, and what kind of punishment should be given. The process of public prosecution cases is generally divided into three stages, namely, the investigation stage of public security organs, the examination and prosecution stage of public prosecution organs and the trial stage of courts. According to the regulations, if the procuratorial organ believes that the criminal facts of the criminal suspect have been ascertained, the evidence is true and sufficient, and criminal responsibility should be investigated according to law, it shall make a decision on prosecution. The time for procuratorial organs to review and prosecute is 1 month, and major and complicated cases can be extended by half a month; If supplementary investigation is needed, the procuratorate may return it to the public security organ for supplementary investigation. Return for supplementary investigation shall be limited to two times, and each time shall not exceed 1 month. After the stage of examination and prosecution is over, the public prosecution organ shall promptly transfer the case file to the court for trial. When trying a case of public prosecution, the people's court shall pronounce a judgment within two months after accepting it, and no later than three months. For a case that may be sentenced to death or an incidental civil lawsuit, if one of the circumstances stipulated in Article 156 of this Law occurs, it may be extended for three months with the approval of the people's court at the next higher level; Due to special circumstances need to be extended, it shall be submitted to the Supreme People's Court for approval. Legal basis: Article 202 of the Criminal Procedure Law of People's Republic of China (PRC). When trying a case of public prosecution, the people's court shall pronounce a judgment within two months after accepting it, and no later than three months. If the people's court changes its jurisdiction, it shall be counted from the date when the changed people's court receives the case. The people's court shall recalculate the time limit for hearing a case transferred to the people's court after the supplementary investigation by the people's procuratorate is completed.
