Husband and wife divorced and went to the same law firm?

A couple divorced, and both men and women asked lawyers to go to court. Unfortunately, however, both parties turned to the lawyers of the same law firm for help. Recently, the judge of Rongchang District Court decided that this situation belongs to dual agency and is not allowed in principle. After the man learned what had happened, he dissolved the agency relationship with the lawyer.

In May this year, Ms. Lu, who lives in Rongchang District, filed a complaint with the court on the grounds that she had a bad relationship with her husband, Mr. Chen, and asked the court to sentence her to divorce.

However, during the trial of this case, when examining the case, the judge in charge found that both the defendant and the litigation agent of the defendant in this case were lawyers of the same law firm. In view of this situation, the presiding judge explained it and ordered it to correct or change it immediately.

In the end, Mr. Chen's attorney voluntarily terminated the agency relationship with Mr. Chen and refunded the lawyer's agency fee to Mr. Chen.

The behavior that different lawyers of the same law firm act as agents for the original and the defendant at the same time is still a double agent, which is not allowed in principle.

At the same time, according to the provisions of the Measures for the Administration of Law Firms of the Ministry of Justice, a law firm shall conduct a conflict of interest review on uniformly accepted businesses, and shall not illegally accept businesses that have conflicts of interest with those undertaken by the firm and its clients.

It seems that husband and wife are connected, and the agent ad litem has found the same law firm.
