Not long ago, Lang Yongchun, a former celebrity of CCTV, was arrested for drunk driving during the National Day. As soon as this happened, everyone immediately thought of Gao, the first celebrity who was caught drunk. 20 1 1 was detained on suspicion of dangerous driving, and was finally sentenced to six months' criminal detention and fined 4000 yuan.

This fine is nothing, but it would be terrible to lose your freedom for half a year. I have to say that being short and tight has played a good demonstration role, and people's understanding of drunk driving has suddenly improved by N grades. If I drink while driving, I would rather spend some money and time to find a driver than spend half a year in prison.

Then my question comes: under what circumstances should I live in a detention center and under what circumstances should I live in a prison? What's the difference between them?

This problem has actually existed in my mind for a long time and has never been explained. Recently, I met a friend who is a prison guard, and I was suddenly enlightened. Take this opportunity to share with you.

(1) Who is detained: In fact, in a broad sense, all places where prisoners are detained, including prisons, detention centers and detention centers, are regarded as prisons. In a narrow sense, according to the provisions of the Criminal Law and the Criminal Procedure Law, criminals sentenced to death with a two-year suspension, life imprisonment or fixed-term imprisonment should all execute their sentences in prison. In other words, the prisoners here are all convicted criminals.

(2) Function: Prison is the national penalty execution organ. Prisons should implement the principle of combining punishment with reform and combining education with labor to transform criminals into law-abiding citizens.

(3) Competent authority: The competent authority of a prison is the Prison Administration, and the highest administrative authority is the Ministry of Justice.

(1) Who to detain: The detention center can only be regarded as a place for temporarily detaining criminal suspects. Detain criminal suspects who have been arrested and detained according to law. In other words, people who enter the detention center are not necessarily criminals. If the remaining sentence of a criminal sentenced to fixed-term imprisonment is less than three months before delivery for execution, the detention center shall execute it on his behalf.

(2) Function: The task of the detention center is to put the criminal suspects in custody on armed alert according to national laws to ensure safety; Educating criminal suspects; Manage the life hygiene of criminal suspects; Ensure the smooth progress of investigation, prosecution and trial. The armed guards and escorts of criminal suspects in detention centers shall be held by armed police.

(3) Competent authorities: Detention centers and detention centers are administratively managed by the Public Security Bureau.

The difference between a detention center and a prison is that criminals can meet their relatives and guardians while serving their sentences in prison, but it is not necessary to enter a detention center. Before the court decision is issued, only lawyers can meet people suspected of criminal offences, and no one else has the right to meet them.

Detainee: a person who has been given administrative punishment for detention by public security organs and state security organs according to law; A person detained by the people's court according to law.

Detention includes administrative detention, judicial custody and criminal detention. In either case, as long as the case-handling personnel of the public security organ think it is necessary to detain the criminal suspect, they will fill out a detention report for letters and visits, specify the relevant situation and reasons, and issue a detention certificate after being reviewed by the department leader and approved by the person in charge of the public security organ, and then detain. In another case, the procuratorate can also detain the criminal suspect, but in the end it needs to be sent to the public security organ for execution.

It seems that the detention center is very similar to the detention center, right? In fact, there is a big difference between the two. Simply put, if you are detained in a detention center, it means that you are suspected of committing a criminal offence, and you have to go through three stages: investigation, prosecution and trial. So the detention time is uncertain. Criminal cases range from 3 months to 1 year. If you are held in a detention center, it means that you only accept public security punishment or administrative punishment, and generally do not involve criminal law. The longest detention time is 15 days, even if several illegal acts are punished together, it will not exceed 20 days.

And even if you enter the detention center, if you take the entrance examination, your child is born, or your close relatives are dying or dead, you can apply for leave, and you can continue to be detained after you finish your work.
