Can pregnant women be exempted from criminal responsibility for drug-related crimes?

Drug-related crimes committed by pregnant women cannot be exempted from criminal responsibility, but generally they will not be sentenced to death. There are strict restrictions on prisoners on death row. The death penalty is not applicable to people under 18 years of age at the time of the crime and women who are pregnant at the time of trial. The death penalty does not apply to people who have reached the age of 75 at the time of trial, except those who cause death by particularly cruel means. Therefore, drug-related pregnant women are generally not sentenced to death, but they should be investigated for criminal responsibility.

The conviction and sentencing standards for drug trafficking cases are as follows:

1. Smuggling, trafficking, transporting or manufacturing opium of more than one kilogram, heroin or methamphetamine of more than fifty grams or other drugs in large quantities;

2. ringleaders of drug smuggling, trafficking, transporting and manufacturing groups;

3. Armed cover for smuggling, trafficking, transporting and manufacturing drugs;

4. Resisting inspection, detention or arrest by violence, if the circumstances are serious;

5. Participate in organized international drug trafficking.

Applicable conditions A criminal sentenced to criminal detention or fixed-term imprisonment of not more than three years may be suspended if he meets the following conditions at the same time. Among them, people under 18 years old, pregnant women and people over 75 years old should stop taking:

(a) the circumstances of the crime are relatively minor;

(2) showing repentance;

(3) There is no danger of committing a crime again;

(four) the announcement of probation has no significant adverse effects on the community where he lives.
