I was injured while working in a factory in Fuyang City, Hangzhou City, Zhejiang Province, and now my work injury is classified as Grade 8. How to compensate and what expenses should be compensated?

Article 37 (8) of the Regulations on Industrial Injury Insurance; Workers with work-related injuries who have been identified as level 8 disabilities enjoy the following benefits:

(1) The one-time disability allowance paid by the industrial injury insurance fund is 1 1 monthly salary;

(two) the expiration of the labor employment contract, or the employee himself proposes to terminate the labor employment contract, the industrial injury insurance fund pays a one-time medical subsidy for work-related injuries, and the employer pays a one-time disability employment subsidy. Specific standards for one-time medical subsidies for work-related injuries and one-time disability employment subsidies shall be formulated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.

The term "my salary" as mentioned in these Regulations refers to the average monthly payment salary of the injured workers 12 months before they suffer from accidents or occupational diseases. If my salary is higher than 300% of the average wage of employees in the overall planning area, it shall be calculated according to 300% of the average wage of employees in the overall planning area; If my salary is lower than 60% of the average wage of employees in the overall planning area, it shall be calculated according to 60% of the average wage of employees in the overall planning area.

Article 23 of the Regulations for the Implementation of the Labor Contract Law stipulates that if an employer terminates the labor contract of an injured employee according to law, it shall not only pay economic compensation in accordance with the provisions of Article 47 of the Labor Contract Law, but also pay a one-time work-related injury medical subsidy and disability employment subsidy in accordance with the provisions of the state on work-related injury insurance.

(The newly revised Regulations on Work-related Injury Insurance shall come into force as of 20110).

Zhejiang Provincial Government Zhejiang [2003] No.52 (Abstract) One-time medical subsidy for work-related injuries and disability employment subsidy. The average monthly salary of employees in the work-related injury insurance co-ordination area where the unit is located is 60 months for grade five, 50 months for grade six, 20 months for grade seven, 0/4 months for grade eight/kloc-0, 8 months for grade nine and 4 months for grade ten. Workers with work-related injuries who are less than five years away from the statutory retirement age will be given a one-time work-related injury medical subsidy and disability employment subsidy according to the standard of decreasing by 20% every week and year. Workers with work-related injuries who have reached retirement age and gone through retirement procedures do not enjoy one-time work-related injury medical subsidies and disability employment subsidies.
