Legal basis:
Article 264 of the Criminal Law: Whoever steals public or private property in a relatively large amount, or commits repeated theft, burglary, armed theft or pickpocketing, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also or only be fined; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years and shall also be fined; If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or confiscated.
The Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Laws in Handling Criminal Cases of Theft (hereinafter referred to as the Interpretation) was implemented on April 4, 20 13. According to the requirements of the Interpretation, combined with the economic development and social security situation in our province, the specific amount standard for the execution of criminal cases of theft in our province was determined through research:
1, theft of public and private property is "a large amount", starting from 2000 yuan;
2. Theft of public and private property is "huge", starting from 50,000 yuan;
3. Theft of public and private property is "extremely huge", starting from 400,000 yuan.
Article 72 of the Law on Public Security Administration Punishment commits one of the following acts, and shall be detained for more than 18 days and less than 15 days, and may be fined less than 2,000 yuan; If the circumstances are minor, they shall be detained for less than 5 days or fined for less than 500 yuan:
(a) illegal possession of opium less than 200 grams, heroin or methamphetamine less than 10 grams or other small amounts of drugs;
(2) Providing drugs to others;
(3) taking or injecting drugs;
