What was the whole story of the Zhang Yuhuan incident?

Zhang Yuhuan (1967 September 18-), a villager from Zhangjia Village, Zhentouling, Gong Zhen Village Committee, Jinxian County, Nanchang City, Jiangxi Province, China.

In February, 26-year-old Zhang Yuhuan was accused of killing two boys in the same village. 1995 1, Zhang Yuhuan was sentenced to death by Nanchang Intermediate People's Court for intentional homicide with a two-year suspension. In March of the same year, the Jiangxi Provincial High Court revoked the first-instance judgment on the grounds of "unclear facts and insufficient evidence" and ruled that Nanchang Intermediate People's Court would retry the case.

On 200 1, Nanchang Intermediate People's Court made a final judgment on Zhang Yuhuan's case and upheld the judgment of "sentenced to death, suspended for two years, deprived of political rights for life".

2065438+In March 2009, Jiangxi Higher People's Court made a retrial decision. At the trial, the public prosecutor suggested that Zhang Yuhuan be acquitted according to law.

On August 4, 2020, the Jiangxi Higher People's Court decided after retrial that the evidence on which Zhang Yuhuan's intentional homicide was based in the original trial did not meet the exact and sufficient legal proof standard, and that the facts of the defendant's intentional homicide were unclear and the evidence was insufficient. According to the principle of no doubt, he can't be found guilty.

So far, Zhang Yuhuan has been deprived of his freedom for 9,778 days. In the past 27 years, he has become the acquitted party with the longest known detention time in China.

social influence

The Central Committee not only issued the first guiding opinion on preventing unjust, false and misjudged cases, but also made it clear in the Opinions on Establishing and Perfecting the Working Mechanism for Preventing Criminal Unfair, False and Misjudged Cases that "confessions collected by extorting confessions by torture or illegal methods such as freezing, starving, drying, baking and fatigue interrogation are excluded". All these efforts are aimed at protecting judicial justice.

There are many discussions about whether Zhang Yuhuan was tortured to extract confessions in those years, but we haven't seen the response of the functional departments to this investigation. It is hoped that the relevant departments in Jiangxi can face up to the problem, respond to public concerns with in-depth investigation, make up for "late justice" with strict accountability, and avoid the recurrence of tragedies with thorough judicial justice.
