Our position is paralegal, and our main job is to help lawyers solve related businesses, including: dealing with general affairs and contact work in the process of lawyers' business activities; The preparatory work before the trial is to prepare for the lawyer to hear the case, so that the litigation agent can complete it smoothly and efficiently; Drafting legal documents under the guidance of lawyers; Conduct or assist in investigation and evidence collection, and conduct or assist in case source development.
(a) lawyers familiar with the handling process
The first step in entering a law firm is to sort out the files. In the process of sorting out the files, I have a detailed understanding of the classification of various documents that should be filed, and I have a certain degree of familiarity with the procedures and processes of civil cases from filing to conclusion. Although all the written documents are relatively simple, they are still written according to the template, but there are still many mistakes, so it is inevitable to check them repeatedly. From this, we also realize that lawyers are ordinary people and have to do a lot of trivial work. Their life and legal work are not as simple as we thought before, and the bitterness and sweat inside are unimaginable to ordinary people.
(2) Writing legal documents and cultivating legal practical thinking.
A qualified legal document is a formal document with its own format and requirements. Aside from the format and requirements, the writing of legal documents requires precision, accuracy and thoroughness, which reflects the professional level and writing level of lawyers. When I was an intern, I tried to write all kinds of documents, such as a complaint, a defense, a power of attorney, and a transcript of my client's conversation. For example, I just started writing defense opinions, because I was unfamiliar with the application of knowledge, and I didn't know how to write them at first. Later, I felt that defense opinions are generally based on the facts of the case, the probative force of evidence and legal procedures. According to these ideas, I analyzed the whole case and wrote the first defense opinion in my life based on my understanding of the case.
(3) Connecting with practice and learning legal skills.
During my internship in the law firm, I got the help of many lawyers. Wandering among different lawyers' handling styles, I deeply felt my own shortcomings and abilities that need to be improved, such as insufficient angle and depth in analyzing evidence and finding loopholes. In order to make up for my own shortcomings, I read most of the lawyers' abstracts in the law firm during this period, and I often read legal documents in the conference room at noon to constantly improve myself. At the same time, they will also follow lawyers to the legal aid center, industrial and commercial bureau, police station and other departments to investigate and collect evidence. In the process of investigation and evidence collection, we deeply realize that the case materials obtained by defense lawyers through marking are very limited, and there are many restrictions for lawyers to collect evidence from victims and witnesses.
(4) Listen in on cases and pay attention to judicial procedures. After listening in and studying the case at this stage, I realized that the trial of the case was not as full of heated debate as I expected, nor was it wonderful or touching. In the past, the mock trial we participated in in school activities was a criminal case, which paid more attention to the procedure and the trial was more serious. However, many procedural issues have been omitted after the actual civil trial, and we feel that the trial is strict but flexible.
(d) Follow the footsteps of internship and deepen the impression of internship.
Lawyer's work is rigorous and realistic, and lawyer's thinking is sharp and dialectical. In the face of cases, lawyers can often solve them quickly according to their knowledge and experience. I prepared a notebook during my internship and used to record my experiences every day when I returned to my residence. After that, I insisted on reading relevant legal books. After contacting these high-quality law firms, I realized that lawyers should be generalists. For example, to do construction cases, you need to learn related knowledge such as building structural engineering contracting, and you can't do the case only by legal knowledge.
Law stands for fairness and justice. Lawyers are one of the legal professionals, and their professional ethics must be strictly observed. As a freelancer, while gaining freedom, you must also bear the corresponding risks. Without the minimum wage guarantee, everything you get depends on your own business efforts. What you get on paper is so shallow that you never know what you have to do. During my short internship, I deeply felt my shallow knowledge and lack of professional knowledge in practical application. I studied Dafa or law in a strict sense, but in practice, many of them are actually departmental regulations or a specific clause. Law is a superstructure, which is very practical. Every year after the two sessions, new laws are produced, and all departments and industries are constantly reforming in the process of exploration. Lawyers' learning ability and acceptance ability must always be highly conscious. After acceptance, the documents should be coordinated with the actual situation to find the balance point and loopholes.
A journey of a thousand miles begins with a single step. This short and substantial internship for more than a month has taught me the law outside of books. At the same time, it also made me realize the society outside school. There are no unified students around, but interests of all ages, occupations and qualities. Different cases, different parties, their joys and sorrows, joys and sorrows, lawyers are a little numb after watching too much. Lawyers should pay attention to protect themselves and master more social skills in their practice. This internship also taught me the attitude and way of dealing with people, that is, being modest and eager to learn, and affirming myself appropriately. Although the legal situation and employment prospects faced by law students are still grim, and there are many problems faced by themselves, the enlightenment given by the internship has made me continue to strengthen my career choice.
