How long does it take to close a criminal case?

according to the criminal procedure law of People's Republic of China (PRC) and the regulations of the state, general criminal cases generally go through three stages, namely, investigation stage (public security organs), examination and prosecution stage (people's procuratorate) and trial stage (people's court). In the investigation stage, the public security organ will, according to the specific circumstances of criminal detention, submit an arrest to the procuratorate within three days, which can be extended for one to four days and up to 3 days at the longest. The procuratorate will generally decide whether to approve the arrest within seven days, and this stage can last for 3-1 days at the earliest. The investigation period after arrest shall generally not exceed two months. If the case is complicated, it may be extended by one month with the approval of the people's procuratorate at the next higher level. With the approval of the provincial procuratorate, cases committed by areas with inconvenient transportation, major criminal groups and fugitives can be extended for two months. A criminal suspect who may be sentenced to fixed-term imprisonment of not more than 1 years may be extended for two months with the approval of the provincial procuratorate. The review and prosecution stage is generally one month, and major and complicated cases can be extended by half a month. If the procuratorate deems it necessary to make supplementary investigation after examination, it may return it to the public security organ for supplementary investigation, or it may make its own investigation. The supplementary investigation shall be completed within one month and the supplementary investigation shall be limited to two times. In the trial stage, if there is no appeal or protest, it is generally two months, and the longest is six months. To sum up, for criminal cases, there is only the longest closing time, not the fastest closing time. The law stipulates: "China People and the State Criminal Procedure Law" Article 28th People's Court shall accept a case of public prosecution within two months after the judgment, and not more than three months at the latest. For a case that may be sentenced to death or a case with incidental civil action, if one of the circumstances stipulated in Article 158 of this Law occurs, it may be extended by the people's court at the next higher level for three months; Due to special circumstances need to be extended, it shall be submitted to the Supreme People's Court for approval. When a people's court changes its jurisdiction, the trial period shall be counted from the date of acceptance by the people's court that changed its jurisdiction. If the case of supplementary investigation by the people's procuratorate is transferred to the people's court after the supplementary investigation, the people's court shall recalculate the trial period.
