After living together in love
She found out that her boyfriend was married and had children.
Ms. Wang was born in 1994 and lives in Renhe District, Panzhihua City, Sichuan Province. When she was 15 years old, her parents died unexpectedly. Since then, she and her grandmother have lived together.
At a dinner party in September 2020, I was introduced to Mr. Tang, who was single, and they added WeChat to each other. Mr. Tang is a native of Wusheng County, Sichuan Province. He used to live in Chongqing. In the later chat, Mr. Tang, who was 1 year younger than her, said that he was single, and began to be caring and attentive to Ms. Wang, expressing her love.

At that time, Ms. Wang was working in a bank. On May 7, 2022, Jinjiang Court of Renhe District People's Court of Panzhihua City held a hearing on this private lending dispute. Ms. Wang asked the court to order Mr. Tang to repay the loan of 400,000 yuan, pay the corresponding interest and compensate the lawyer's agency fee of 654.38+0,000 yuan. Mr. Tang did not appear in court and entrusted his mother and lawyer to participate in the lawsuit.
"The original loan does not exist, the two sides are lovers, and all the money is used for living expenses during cohabitation." Mr. Tang argued that the IOU was issued under special circumstances, which was not Mr. Tang's real intention, nor was it a real capital flow, and should not pay 400,000 yuan. "In order to get away as soon as possible, Mr. Tang wrote an IOU to Ms. Wang."
The second trial was sentenced to return 97,000 yuan.

After hearing the case, the court held that the IOU was based on a bill made unilaterally by Ms. Wang, and the relevant money recorded in the bill did not correspond to the evidence submitted by Ms. Wang. At the same time, Ms. Wang regards the money received by Mr. Tang and the living expenses of both parties as loans, which is inconsistent with the objective facts. Therefore, Ms. Wang advocated that Mr. Tang should use this loan to repay the loan of 400,000 yuan, which was not supported by the court.

The court held that the confirmation of the loan amount should be comprehensively determined in combination with the fact that Ms. Wang transferred money, the emotional level of both parties, and the * * * expenses during the love period. During their love, Mr. Tang played and deceived Ms. Wang, and there was a major fault. In the end, the court made a first-instance judgment after trial. Mr. Tang returned Ms. Wang's loan of 6,543,807,400 yuan and the corresponding interest, and compensated Ms. Wang's attorney fee of 6,543,800 yuan.
After the judgment of the first instance, Mr. Tang refused to accept it and appealed to the Panzhihua Intermediate People's Court. Recently, the Red Star journalist learned from the hospital that in the second trial, Mr. Tang submitted new evidence to prove that he transferred more than 60,000 yuan to Ms. Wang. The court also found that the court of first instance ruled that there was double counting of 1.7 million yuan transferred by Ms. Wang to Mr. Tang. In the end, the court ruled in the second instance that Mr. Tang paid Ms. Wang a loan of more than 97,000 yuan and the corresponding interest and lawyer's agency fee.
