As far as "lawyer" qualifications are concerned, it includes: First, having certain legal knowledge, in accordance with the provisions of the current "Lawyers Law". The second is to pass the national "Legal Professional Qualification Examination"; the third is to be approved by the national judicial administrative department and obtain a practicing certificate; the fourth is to provide legal services to the society and make this a career.
So a lawyer is a practitioner who has passed the national legal professional qualification examination and obtained a lawyer's practicing certificate in accordance with the law, accepts the entrustment or designation of the client, and provides legal services to the client. The essence of a lawyer is a legal service worker whose profession is to provide legal services to society.
Among the above four basic characteristics, the first one or two are other legal workers, such as law enforcement workers, judicial trial workers (judges), and judicial prosecutors (prosecutors)** ** Possessed; the latter two are unique to "lawyers" as legal workers.
Scope of practice
Article 28 of the current "Lawyers Law" stipulates that lawyers may engage in the following businesses:
(1) Acceptance of services from natural persons, legal persons or other organizations
(2) Accept the entrustment of civil cases and administrative cases, and act as an agent to participate in litigation;
(3) Accept the commission of criminal suspects and defendants in criminal cases people’s commission. (6) Accept entrustment and provide non- Litigation legal services;
