Jiaxing Property Management Regulations and New Regulations (full text)

Chapter I General Provisions Article 1 In order to standardize residential property management activities and safeguard the legitimate rights and interests of owners and property service enterprises, these Regulations are formulated in accordance with the National Law of the People's Republic of China, the Property Management Regulations of the State Council and other laws and regulations, and in combination with the actual situation of this Municipality.

article 2 residential property management as mentioned in these regulations (hereinafter referred to as property management) refers to the behavior that residential owners select property service enterprises to manage and maintain the maintenance, environmental sanitation and related order of houses and ancillary facilities in accordance with the provisions of the property service contract.

article 3 property management-related activities shall follow the leadership of the party, adhere to professional services and practice owner autonomy.

article 4 the municipal people's government shall sort out the matters and law enforcement agencies involved in the administrative punishment of property management, make a list and publish it.

relevant law enforcement departments should promptly investigate and deal with the illegal acts reported and complained by property service enterprises against owners.

fifth city and county (city, district) construction departments are responsible for the supervision and management of property management activities within their respective jurisdictions.

county (city, district) construction departments should strengthen the professional training and guidance for neighborhood (village) committees, owners' committees and property service enterprises.

article 6 the municipal construction administrative department shall establish a digital platform for property management, promote the construction of smart property and improve the level of property management.

electronic voting is encouraged to vote on the same decision made by the owner.

article 7 the property service industry association shall strengthen industry self-discipline, conduct business training, assist in handling property management disputes, and promote the healthy and orderly development of the industry.

chapter ii owners and owners' organizations

article 8 the construction unit shall, within 3 days from the date of the establishment of the owners' meeting in the property management area, report the establishment of the owners' meeting in writing to the neighborhood office (town people's government) or the residents' committee where the property is located.

if the construction unit fails to raise funds in time, the owner may apply in writing to the subdistrict office (town people's government) or the neighborhood (village) people's committee for the establishment of the owners' meeting.

Article 9 Sub-district offices (township people's governments) and neighborhood committees shall, within 6 days from the date of receiving the written report of the construction unit or the written request of the owners, guide the owners to set up the preparatory group for the owners' meeting.

article 1 the preparatory group is composed of the owner's representative and relevant personnel of the sub-district office (town people's government), neighborhood (village) committees and the construction unit, and the number shall be odd. Owners' representatives shall be recommended by the residents' (village) committees, not less than half of the total number of preparatory groups. If the construction unit fails to send members to participate in the preparatory group, it will not affect the establishment of the preparatory group.

The sub-district office (town people's government) or neighborhood committee is responsible for the preparatory group. The preparatory group shall be established in a prominent position within the property management area within three days from the date of publication of the list of members.

article 11 the realty service provider shall, within seven days from the date of the establishment of the preparatory group, provide the preparatory group with the information needed for the preparation of the first meeting of the owners' congress, such as the roster of owners, the inventory of houses, the construction area, the general layout design scheme of the construction project, the list of supporting facilities and the configuration list of realty service houses.

Article 12 The preparatory group shall do the following work:

(1) Confirm the identity of owners, the number of owners and the area of exclusive parts;

(2) determine the time, place, form and content of the first owners' meeting;

(3) drafting the rules of procedure and management regulations of the owners' congress;

(4) determine the voting rules for the first owners' meeting;

(4) determine the voting rules for the first owners' meeting;

(5) to formulate the method for selecting candidates for the members of the owners' committee and determine the list of candidates;

(6) to draw up the election method of the owners' committee.

article 13 the preparatory group shall organize the first meeting of the owners' congress within 9 days from its establishment, and adopt the rules of procedure and management regulations of the owners' congress to elect the owners' committee.

article 14 the preparatory group shall, within 1 days from the date when the owners' committee files the case according to law, hand over all the materials and the balance of preparatory funds to the owners' committee, and the preparatory group shall be dissolved after the handover.

if the first owners' meeting is not organized within the prescribed time limit, the preparatory group may apply to the sub-district office (township people's government) or the neighborhood Committee for an extension of 6 days; If the first meeting of the owners' congress is not postponed or held at the expiration of the extension, the sub-district office (township people's government) and neighborhood (village) committees shall announce the dissolution of the preparatory group, take over the materials and funds, and guide the formation of a new owners' committee within 6 days, and the preparatory group shall be dissolved. Guide the establishment of a new preparatory group within 6 days.

Article 15 If the owners' committee fails to organize regular meetings of the owners' assembly according to the rules of procedure of the owners' assembly, or fails to organize residents' (village) meetings when temporary meetings should be held, it shall report to the sub-district office (town people's government). Sub-district offices (Town People's Government) shall be ordered to convene within a time limit; If it is not held within the time limit, the street office (town people's government) shall guide the owners to hold it.

Article 16 If the property has not been delivered, the owners' committee shall inform the construction unit in writing of the decisions made by the owners' meeting. When the construction unit delivers the property, it shall inform the owners in writing of the matters decided by the owners' meeting.

article 17 the owners' congress may decide to establish an owners' congress. The owners' congress shall perform its duties under the authorization of the owners' congress.

the owners' representatives are elected by the owners in units of buildings, units or floors, with a total number of not less than 5.

the rules of procedure of the owners' congress shall be formulated by the owners' congress.

Article 18 If the identity of the representative of the owners' congress is lost, his representative position shall be terminated from

; If the performance of duties is not in place, the owner's representative decides to terminate his representative position. After the termination of the position of the owner's representative, the relevant owners will be re-elected.

Article 19 If a member of the owners' committee voluntarily terminates his duties under any of the following circumstances, the owners' committee shall make an announcement in a prominent position in the property management area:

(1) The owner's identity is lost due to the transfer or loss of the property;

(2) losing the capacity for civil conduct;

(3) being investigated for criminal responsibility according to law;

(4) other circumstances stipulated by laws, regulations, rules of procedure of the owners' meeting and management regulations.

Article 2 The working expenses of the owners' committee shall be shared by all owners. Upon the decision of the owners' meeting, some members of the owners' committee can enjoy certain allowances.

Article 21 Under any of the following circumstances, the owners' committee shall hire a professional organization to audit the owners' * * * and the working funds of the owners' committee:

(1) The owners' committee is changed;

(2) the director of the owners' committee and the person in charge of finance leave their posts at the expiration of their term of office;

(3) The property has been delivered to the owners * * * *, and the owners' committee has income or working expenses.

(3) The exclusive part of the property that has been delivered accounts for more than 2% of the total area or the proposal of the owners' meeting accounts for more than 2% of the total number of people;

(4) decided by the owners' meeting;

(5) Other circumstances stipulated in the management regulations.

if the owners' committee fails to review in accordance with the provisions of the preceding paragraph, the neighborhood (village) committee shall report to the subdistrict office (town people's government). Street offices (Town People's Government) shall be ordered to make corrections within a time limit; If it is still not corrected within the time limit, it will be hired by the sub-district office (town people's government).

the audit results should be announced in a prominent position in the property management area, and the audit fees can be paid in * * * *.

Article 22 If the owners' committee fails to organize the election on schedule, the sub-district office (township people's government) and the neighborhood committee (village committee) shall guide the owners to hold a meeting of the owners' assembly for the election.

article 23 if the owners' committee is not established or the number of members of the owners' committee is less than half of the total number of members of the owners' committee, the neighborhood (village) committee shall perform the duties of the owners' committee under the guidance and supervision of the county (city, district) construction department and the subdistrict office (town people's government).

chapter iii property management services

article 24 if a construction unit selects property services through bidding, it shall notify the neighborhood (village) committees to send personnel to participate in the bid evaluation.

article 25 after taking over the property, the property service agency shall conduct acceptance of some facilities owned by the owner, and announce the acceptance results in a prominent position in the property management area within 3 days after passing the acceptance.

the inspection shall be carried out under the supervision of the county (city, district) construction department and the sub-district office (town people's government), and the owner's representative shall be invited to participate.

the construction unit and the original realty service enterprise shall cooperate with each other to do a good job in acceptance.

Article 26 A property service provider shall publish the following information in a prominent position in the property management area:

(1) Basic information and complaint telephone number of the property service provider;

(2) the contents and matters of the agreed service, the person in charge, the quality requirements, the charging items and the charging standards, etc.;

(3) Name, qualification and contact information of daily maintenance units such as fire control facilities and elevators;

(4) Name, qualification and contact information of daily maintenance units such as fire control facilities and elevators.

the realty service enterprise shall, before the end of March each year, announce the performance of the realty service contract in the previous year, the use of the realty maintenance funds in the maintenance projects that the realty service enterprise is responsible for implementing, and the partial operation and income of the owners, and report to the owners' meeting and the owners' committee.

article 27 the planned parking spaces, parking spaces and garages that have not been sold for two years from the delivery date of the first house shall be rented out if the owner requests to rent them. If it is developed by stages, the current period of the delivery date of the first house shall prevail.

article 28 if a newly built, rebuilt or expanded civil air defense project is leased for normal use, the lease term shall not exceed three years, and it can be leased continuously. The rental income shall be given priority to the maintenance and management of civil air defense projects.

article 29 the construction unit shall undertake the responsibility of property warranty and pay the property warranty fund in full.

if the insurance for potential defects in engineering quality insured by the construction unit conforms to the warranty scope and warranty period stipulated by the state and the province, and is approved by the county (city, district) construction department, the property warranty fund is exempted. Specific measures shall be formulated by the municipal construction administrative department in conjunction with relevant departments (units) and promulgated and implemented after being approved by the Municipal People's government.

article 3. after deducting reasonable expenses, part of the income generated by using * * * to conduct business activities shall be owned by the owner * * *.

if the owners' committee is not established, it will be managed by the neighborhood (village) committee under the supervision of the subdistrict office (township people's government).

*** The revenue is mainly used for the following expenses:

(1) Special maintenance expenses of the property;

(2) working expenses of the owners' committee;

(3) allowances for some members of the owners' committee;

(4) audit fees;

(5) other matters decided by the owner.

*** Income should be accounted for separately.

article 31 the owner shall pay the property fee as agreed.

if the property is not delivered, the construction unit shall pay the property fee.

article 32 after all owners * * * * have passed the experience of water supply, power supply, gas supply, heating, communication, cable TV and other facilities, the owners * * * * decide that they can transfer them to relevant professional units, and the relevant professional units shall accept them and assume the responsibility of repair, renewal and maintenance.

chapter iv legal liability

article 33 in case of violation of the provisions of these regulations, laws, administrative regulations and local regulations of this province have stipulated legal liability, such provisions shall prevail.

article 34 where a property service provider fails to provide relevant information as required in violation of article 11 of these regulations, the construction administrative department shall order it to make corrections within a time limit and impose a fine of not less than 1, yuan but not more than 1, yuan.

article 35 in violation of the provisions of article 16 of these regulations, if the construction unit fails to inform the owner of the relevant decision in writing, the construction administrative department shall order it to make corrections within a time limit and impose a fine ranging from 5, yuan to 5, yuan.

article 36 in violation of the provisions of the first paragraph of article 25 of these regulations, if the property service provider fails to announce the acceptance results as required, the construction administrative department shall order it to make corrections within a time limit and impose a fine of more than 5, yuan and less than 5, yuan.

in violation of the third paragraph of article 25 of these regulations, if the construction unit or the original realty service enterprise refuses to cooperate with the acceptance work, the construction administrative department shall order it to make corrections within a time limit and impose a fine of more than 1, yuan and less than 1, yuan.

article 37 in violation of the provisions of article 26 of these regulations, if the property service provider fails to publish relevant information as required, the construction administrative department shall order it to make corrections within a time limit and impose a fine ranging from 5, yuan to 5, yuan.

article 38 in violation of the provisions of article 27 of these regulations, if the owner is not leased the right to use parking spaces and garages, the construction administrative department shall order him to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than 5 thousand yuan but not more than 5 thousand yuan shall be imposed.

article 39 in violation of the provisions of article 28 of these regulations, if the single lease term is more than three years, the construction administrative department shall order it to make corrections within a time limit and impose a fine of not less than 1, yuan but not more than 1, yuan.

Article 4 If the relevant professional unit refuses to accept the violation of Article 32 of these regulations, the construction administrative department shall order it to make corrections within a time limit and impose a fine of 1, yuan to 1, yuan.

article 41 where the property service is changed without authorization for matters that should be decided by the owner, the construction administrative department shall order it to make corrections within a time limit and impose a fine of more than 1, yuan and less than 1, yuan.

chapter v supplementary provisions

article 42 the management and supervision activities of residential properties and non-residential properties managed by owners themselves shall be implemented with reference to these regulations.
