Bail pending trial means that in criminal proceedings, the public security organs, people's procuratorates, people's courts and other judicial organs provide criminal suspects or defendants who have not been arrested or who need to change compulsory measures after arrest, in order to prevent them from escaping. During investigation, prosecution and trial, the person shall be ordered to provide a guarantor or pay a deposit, and issue a letter of guarantee or guarantee, and shall take a compulsory measure of summoning the person to a detention center without being detained or temporarily releasing the person from custody. Implemented by the public security organs.
"Criminal Procedure Law": Article 65 clearly stipulates that the people's courts, people's procuratorates and public security organs may release criminal suspects or defendants on bail pending trial under any of the following circumstances:
< p>(1) Those who may be sentenced to public surveillance, criminal detention, or independent additional penalties;(2) Those who may be sentenced to a penalty of more than fixed-term imprisonment, and being released on bail pending trial will not cause social danger;
< p> (3) The person may be sentenced to a penalty of fixed-term imprisonment or more.(3) Women who are seriously ill, unable to take care of themselves, pregnant or breastfeeding their own babies will not pose a social risk by being released on bail pending trial;
(4) Duration of detention After expiration, the case has not been concluded and needs to be released on bail pending trial.
Bail pending trial and residential surveillance shall be implemented by the public security organs.
